LAS CRUCES, N.M. (KFOX14) — KFOX14 sat down with the Dona Ana County District attorney Gerald Byers for a one-on-one interview Friday.
The interview came after several requests to meet with him regarding case dismissals.
During the interview, Byers stood firm on his stance that he was not required to hand over any of that information.
KFOX14’s Ariana Parra: “I’ve asked the second district attorney‘s office, the 10th District attorney‘s Office, the ninth District attorney‘s Office, and the 12th district. attorney‘s Office and they’ve been able to provide me with every dismissed case throughout 2023. So I’m just curious as to why your office cannot provide that.”
“I’m not saying that we can’t what I’m saying is that the rule does not require that we do,” Byers said.
KFOX14 asked Byers why he wouldn’t release the information even though he wasn’t required to.
KFOX14’s Ariana Parra: “Why wouldn’t you provide it for transparency reasons for your constituents?”
Byers said his office is busy dealing with hundreds of cases and he’d rather not waste time looking in the rearview mirror.
“I frankly could care less if all the rest of these agencies provide you their answers,” Byers said. “The answer is in accordance with the legal statutes, I’m going to move on. I’m not going to get caught up in the drama.”
Byers reminded KFOX14 he did provide some statistics during a news conference he held in November.

“I’ve answered your question already. So why do you keep persisting on this?” Byers asked.
While he did release numbers of dismissed cases, he did not include dates or the reasonings behind the dismissals.
Byers stood strong in his decision that he doesn’t need to hand over information, just because others have.
“I said that I’m able. I am deciding not to,” Byers said.
Byers questioned KFOX14’s intentions when bringing up the information provided by other DA offices.
“What are you going to do with the reports that you received from the other districts?” Byers asked. “It’s about the drama, isn’t it?”
However, the information requested had nothing to do with drama.
KFOX14 requested the information from other offices to show that the information could be shared and had already been handed over without hesitation by other DAs.
During the interview, Byers said the information was public record and KFOX14 could get ahold of it.
However, he did not explain how.
KFOX14’s Ariana Parra: “So I’d have to be requesting that from the administrative offices of district attorneys?”
“Some work you have to do,” Byers said.
