BIRMINGHAM, Ala. (WBRC) – In a recent interview, Birmingham attorney Roger Appell provided valuable insights into the legal concept of Youthful Offender Status, addressing common queries and shedding light on the intricacies of its application.
According to Appell, the law extends the opportunity for anyone under the age of 21 to apply for Youthful Offender Status, which could result in a sentence of no more than three years and the sealing of their criminal record.
“It applies to any crime, but the higher the crime—capital murder, murder, robbery, rape—the less likely a judge is to grant it,” noted Appell. “In crimes of violence, it’s very rare. There has to be exceptional circumstances for a judge to grant it.”
Appell emphasized that while Youthful Offender Status can be sought more than once, the likelihood of a judge approving an application for a repeat offender diminishes. He pointed out that the District attorney’s office can also object to the application, highlighting the legal nuances surrounding its implementation.
“It’s a tool defense attorneys use to try and get their clients the best outcome. It’s a very useful tool. Any client you have under the age of 21, you’re going to apply for youthful offender,” Appell explained. “You don’t have to, but you would be committing legal malpractice if you didn’t.”
One crucial aspect of Youthful Offender Status is that it requires the defendant to waive their right to a trial, putting their fate in the hands of a judge. Appell clarified that while the potential punishment could be up to three years in prison, it is more likely to result in probation. However, he emphasized that a judge must first approve the application before any such outcome can be determined.
