CARROLL COUNTY, Ind. — The defense team in the Delphi murders case filed two more motions in an effort to cancel the hearing scheduled for Feb. 12 in Fort Wayne.
The main reason defense attorneys Andrew Baldwin and Brad Rozzi say judge Frances Gull should not hold this hearing is until there’s a hearing on their request to have her disqualified from the case. Their concern is she should not rule on any other issue before deciding whether or not she should continue on the case.
Allen is charged with murder for the deaths of Abby Williams and Libby German nearly seven years ago.
The prosecutor’s request to add four more charges is also on the agenda for the Feb. 12 hearing. Here are the new charges Allen could face:
- Two counts of murder while committing or attempting to commit kidnapping (previously filed Oct. 28, 2022)
- Two counts of murder
- Two counts of kidnapping

But in another filing, Allen’s attorneys say they can’t possibly be ready for that topic since they still don’t have all the evidence back from the previous attorneys.
They said the discovery has to go from the previous attorneys back to the prosecutor’s office and then to them.

They also point to a huge amount of new discovery to review. The attorneys said it will likely take “several weeks” for them to review.
Rozzi also reiterated the same as in a previous filing, that he will be out of the state at the time of the Feb. 12 hearing. He claimed the time and date was set without conferring with Allen’s attorneys.
