MADISON COUNTY, Idaho (KMVT/KSVT) — Chad Daybell, who is facing three first-degree murder charges may need new legal defense to represent him during his upcoming trial in Boise.
Daybell’s attorney, Jon Prior, who has represented Daybell since he was first charged with the crimes, has filed a Motion to Withdraw from the case.
In court documents filed last Thursday Prior said, “Mr. Daybell does not have the ability to pay for counsel’s continued services and Mr. Daybell seeks the appointment of two capital qualified attorneys to represent him in this matter.”
Judge Steve W. Boyce will hear the arguments on the motion this Thursday at the Madison County Courthouse.
Daybell is charged with the murder of his wife’s two children JJ Vallow and Tylee Ryan and his former wife, Tammy Daybell, along with other charges.
The jury trial is scheduled to begin on April 1st of this year in Ada County.
