MEMPHIS, Tenn. – Prosecutors and defense attorneys went back and forth on Friday, arguing whether or not a man accused of shooting several people with birdshot outside of a popular Memphis venue should be behind bars.

The man accused of the shooting, Detawn Gunn, was released without bail by Judge Bill Anderson two weeks ago.
The Shelby County District attorney‘s Office argued that releasing Gunn created a public safety concern. Gunn allegedly fired birdshot at several people after he and another man got into an argument over a parking spot outside of Railgarten. But Gunn’s defense claimed that he is not a threat to the community.

Gunn was charged with five counts of attempted second-degree murder. Judge Anderson made a ruling to release Gunn on his own recognizance. That decision led the DA’s office to appeal the decision to criminal court.

On Friday, Gunn and his family appeared in court as the prosecution and defense made statements and showed video of the August 16 shooting. Assistant Shelby County District attorney Forrest Edwards said that, if the judge grants their appeal, the DA’s office would ask for a bond of $500,000.
“What’s important to us is the seriousness of the offense, the probability of conviction, and the egregious nature of going to a family-centered venue, aiming a gun at an individual, firing two shots, critically wounding him, and hitting two others at peak volume, and that is not good for public safety,” Edwards said.
Judge Jennifer Mitchell will decide if the district attorney‘s office appeal should be granted or not. If she approves the appeal, there will be a bond hearing. Judge Mitchell said she will make that decision Monday morning at 9 a.m.
