Leaders local to San Diego, state and federal leaders met in San Diego on Monday to discuss the effects fentanyl trafficking has on the San Diego community and how they are attacking the problem.

“Illicit fentanyl is being trafficked across our border and sold through our communities leaving unacceptable death, pain, injury and tragedy in its wake,” California attorney General Rob Bonta said.

Local leaders stressed the importance of the fight against illegal trafficking of fentanyl in San Diego County.

“One of the reasons why San Diego has taken on this fight is because we are one of the largest entry points for fentanyl for the entire nation but at the same time we have worked around the clock to be an example of how to stop this threat,” San Diego County attorney General Summer Stephan said.

Drug seizures have found large quantities of fentanyl trafficking

“So far our fentanyl seizures have included over 11 million fentanyl pills. Over 3,000 pounds of powder and just under 300 arrests,” attorney General Bonta said.

A multi-faceted approach is being taken to slow the flow of illicit fentanyl into the country, according to Rob Bonta.

While the effort is underway to tackle fentanyl trafficking, deaths have stopped climbing locally.

“So, while across the nation, we see the number increase to 77,000 in San Diego, our death rate of overdoses remained steady for the very first time to 815 people losing their lives,” Stephan said.

State leaders stress law enforcement action will evolve and continue as needed to stop illegal fentanyl trafficking.

“I’m very well aware the job is far from over and we are going to keep at it and stay aggressive,” attorney General Bonta said.

El Cajon City and community leaders gathered outside police headquarters on Sunday to announce a campaign to garner support to reform Prop 47.

The controversial prop, passed by California voters in 2014, changed particular low-level theft and drug offenses from felonies to misdemeanors.

“What it essentially did was allow people to steal $950 of merchandise from any store with little to no consequences. And it’s lowered the threshold for serious drug crimes, including methamphetamine and fentanyl,” Phil Ortiz, Deputy Mayor of the City of El Cajon, said.

Prop 47 was introduced to Californians as “the Safe Neighborhoods and Schools Act.” Supporters of the prop aimed to reduce the amount of money California spends on incarceration and, in turn, use those savings towards programs that prevent crime in the first place.

“After Prop 47 passed, it saved California $800 million. Eight hundred million…that instead of using it towards incarcerating people, it was used to funnel back into the community to create programs such as mental health services such as substance abuse services,” Mitchelle Woodson, Executive Director & Managing attorney at Think Dignity, said.

At Sunday’s event, the San Diego District attorney‘s office spoke in favor of reforming Prop 47 to address smash-and-grab incidents more aggressively, organized retail theft and the distribution of hard drugs such as fentanyl.

“Across the State of California, district attorneys and city leaders are standing up and saying enough is enough,” Cameron Celeste, San Diego District attorney’s Office Assistant Director Business and Community Relations, said.

However, supporters of Prop 47 say reforming it would have devastating effects on programs aimed at stopping crime before it starts.

“By rolling back what Prop 47 has done to successfully invest into our community, we’re going to be doing more harm than good,” added Woodson.

The El Cajon mayor’s office added they hope to gather enough signatures to place the reform of Prop 47 on the ballot this upcoming November.

Heather Ferbert

Law enforcement officials seized more than 720,000 fentanyl pills in San Diego County last week, which were discovered inside a man’s vehicle in Alpine, the California attorney General’s Office said Wednesday.

The driver’s arrest and seizures of the drugs happened Friday as part of a joint operation conducted by federal and local law enforcement.

According to attorney General Rob Bonta’s Office, more than 150 pounds of fentanyl pills were found in the vehicle, contained in 110 packages. The packages contained blue pills with “M30” markings and the initial investigation determined the pills contained fentanyl.

The alleged driver was arrested and has been charged with transportation of a controlled substance for sale, with additional sentence-enhancing allegations regarding the weight and amount of the drugs seized.

Bonta said in a statement that it represented the largest fentanyl seizure since the Department of Justice’s partnership in 2022 between its Fentanyl Enforcement Program and the multi-agency Fentanyl Abatement & Suppression Team Task Force, which focuses on fentanyl smuggling and distribution within San Diego County.

SAN DIEGO — San Diego law enforcement is looking to shut down a massage parlor in Kearny Mesa that they say is a front for an illegal prostitution enterprise.

City attorney Mara Elliott announced the civil law enforcement action to close the Ocean Spa, located along Kearny Villa Road, on Tuesday, marking the end of a month-long investigation into the business in partnership with the San Diego Police Department’s Vice Unit.

“The owners of Ocean Spa have been masquerading as a legitimate business for far too long,” Elliott said in a statement. “Ocean Spa is a sex shop — not a massage parlor — and it has no place in our community or anywhere else.”

The investigation into Ocean Spa was initiated after numerous complaints were received by law enforcement. According to the city, this included “foot traffic at odd hours, people having intercourse in parked cars and sexual noises loud enough to disrupt nearby church services.”

Man killed, child hurt in wrong-way I-8 crash

Over the last year, SDPD detectives spent more than 125 hours investigating the business for prostitution-related crimes, city officials said.

This included several instances where undercover police officers were offered sex by spa workers, leading to four arrests for prostitution. Although investigators say they are “not convinced” the women were voluntarily involved in the prostitution enterprise.

According to Elliott’s office, more than 1,270 advertisements soliciting sex have also been distributed online by the spa over the last five years.

In the civil law enforcement action, the city attorney is asking a judge to prohibit Ocean Spa from continuing to operate an “illegal red-light business” and impose $100,000 against it in civil penalties. Her office says they are also seeking reimbursement of attorney fees and other costs incurred from “enforcement-related activities.”

No additional details about the investigation or the efforts by law enforcement to shutter the business were immediately available.

The post San Diego City Attorney Mara Elliot looking to shut down Ocean Spa in Kearny Mesa over prostitution allegations appeared first on Attorney Legal Counsel.

SAN DIEGO — San Diego City attorney Mara Elliot filed a civil enforcement complaint against the owners of an apartment complex near the University of San Diego after allegedly leasing out units to students despite receiving dozens of building code and safety violations.

The 13-page complaint, which was filed with the County Superior Court on Monday, details months-long efforts by city officials to get the owners of a 14-unit complex known as “The Carl on Lauretta” to address issues that prosecutors say made the building “unsafe” and unready for tenants.

According to the complaint, The Carl allegedly leased out the units to college students before having an operating fire protection system and elevator. Prosecutors also say the city had not issued the complex a certificate of occupancy, which is required under local law to rent out units.

“Students and parents, desperate to find safe and convenient housing before the school year started, were charged exorbitant rent to move into a building that lacked a working fire emergency system,” Elliot said of the complaint in a release on Monday.  

“As the mother of a college student, I am particularly appalled that anyone would put the lives of our young people at risk to increase their profits,” she said. “We will hold these building owners accountable for cutting corners on our children’s safety.”  

Construction to the four-story building started at 1211 Mollie St. by Crawford Design & Development in April 2022, after a single-family home previously on the site was demolished.

During roughly year-long construction, prosecutors say that Development Services Department (DSD) inspectors completed 83 checks of the property to ensure that the work being done complied with local and state standards. The complaint alleges that only seven passed inspection, indicating that the building was not ready for occupancy.

Despite that, prosecutors allege that Crawford Design and the landlord, HUGS International Corporation, began advertising available units over the summer, later entering into agreements with tenants in August.

In the months after, the complaint says that city staff from DSD, San Diego Fire-Rescue and the Building and Land Use Enforcement Division continued to inspect the premises, allegedly confirming the presence of violations and unlawful occupants.

From August to November, these inspections led to the issuance of 42 citations — each with a $1,000 fine — for building code violations, according to the complaint.

The violations notified the building owners that the units had to be immediately vacated until the certificate of occupancy had been issued by the city and all required inspections had been passed. Prosecutors allege this did not happen.

By failing to comply with the city’s directions, prosecutors allege the building was “blatantly and willfully” in violation of local and state law, and its owners were unlawfully using the property to profit “by collecting rents and receiving income from leasing” it.

“Property owners should be on notice that the City attorney’s Office will not look the other way while they endanger occupants’ lives, and especially not the young lives of our community’s college students,” Elliot continued. “That is why we have taken this action today, and we are confident that the Court will help us make these college students whole.”

According to Elliot’s office, a working fire system has since been added to the building, so the city is no longer seeking immediate vacancy of the building. Instead, prosecutors are asking the court for thousands in civil penalties and the reimbursement of “any money or property” acquired through these violations.

FOX 5 has reached out to Crawford Design and HUGS International Corporation for comment on the complaint, but did not immediately hear back.

RIVERSIDE COUNTY, Calif. (KGTV) — A San Diego man is facing multiple charges in connection to a multi-million dollar scheme involving the theft of luxury cars throughout Riverside County.

On Thursday, 47-year-old Dean Watters of San Diego pleaded not guilty to 12 felonies with charges including embezzlement, car theft and buying or receiving stolen vehicles, a release sent by the Riverside District attorney‘s Office said.

Riverside County’s Deputy District attorney filed a second amended complaint on Thursday for 25-year-old Kendall Jamison Clark of Murrieta. The release said the complaint now has 30 felony charges for Clark following the discovery and recovery of additional stolen cars.

Some of the cars that Clark took were a 2021 Porsche Boxter, a 2021 Lamborghini Aventador, a 2022 Tesla Model Y and a 2022 Lamborghini Urus.

Riverside Auto-Theft Interdiction Detail (RAID) investigators initiated their investigations in September, following reports from several luxury car owners who reported that Clark never returned their vehicles.

When the owners tried to report their cars as stolen, they learned their names were taken off the titles, the release said.

Clark was arrested in San Diego on Oct. 18. Following his arrest, investigators found Watters purchasing the vehicles that Clark stole at various locations throughout Riverside County for prices lower than their actual value.

The release said Watters paid Clark for a group of cars and took them to other locations, including Mexico, where he attempted to resell them. RAID members arrested Watters at the San Diego International Airport on Nov. 27, where he tried to depart to San Francisco.

Watters has a return date for a felony settlement conference and bail review on Dec. 8 and is held on $1 million bail at the Southwest Detention Center.

Clark pleaded not guilty to all charges prior and was released from custody on $250,000 bail. His return date is Dec. 14 for a felony settlement conference at the Southwest Justice Center.

SAN DIEGO — California attorney General Rob Bonta joined volunteers with the San Diego Food Bank Monday to encourage people to donate this holiday season without getting scammed.

The San Diego Food Bank is the largest hunger relief organization throughout San Diego County. It has been a lifeline in the community since 1977 feeding 400,000 each month.

“The holidays are an important time for the San Diego food Bank we do see contributions increase,” said Casey Castillo, San Diego Food Bank’s CEO. He says they see the majority donations for the year in November and December.

“Just like we hope for increased funds, we also see demand increase during the holidays as well,” said Castillo.

As more people give this holiday season, Bonta urges people to be aware of scammers that are looking to take advantage of those looking to make charitable donations.

“Before writing a check, pulling out your credit card or opening PayPal please do your due diligence,” the attorney general said while visiting the Food Bank Monday.

For those planning on making a donation to a nonprofit this holiday season, here are some tips from California officials about how to do so safely:

• Check the Registration Status: All charities and professional fundraisers that solicit donations in California are required to register and submit financial report to the attorney General’s office. Before donating, verify that the organization you are sending money to meets all of the state registration and reporting requirements here.
• Give to Organizations You Trust: Always do your research before making a donation. Review the charity’s annual financial reports to find out how much of your donation will actually be spent on the charitable cause, as well as how much, if any, will go to overhead and employee compensation.
• Don’t Be Pressured by Telemarketers: If you receive a call from a telemarketer, do not fall for pressure tactics or threats. Remember, you have the right to decline a donation request and can hang up. If you are interested in donating to a particular organization, you can visit their website or contact them directly to get more information.
• Be Cautious of “Look-Alike” and Fake Websites and Emails: Be on the lookout for websites and emails that use slightly different web addresses or email addresses in order to pass off as a legitimate charity. • Protect Your Identity: Never give your Social Security number, credit card information or other personal identifiable information in response to a charitable solicitation.
• Be Careful When Making Electronic Donations: Electronic donations — such as donations made via text, QR Codes and portable credit card readers — have become common practice due to their ability to provide a quick and easy way to donate on the spot. Always confirm that the solicitation was submitted by a charity, or that the person facilitating the transaction is authorized to receive donations on behalf of a charity. Always check your receipt and your credit card/online payment method statement to ensure that the transaction charged to your account is accurate.

SAN DIEGO (AP) — Former Buffalo Bills punter Matt Araiza is being dropped from a lawsuit filed by a woman who alleged she was raped by San Diego State University football players in 2021.

The woman agreed Tuesday to dismiss Araiza from the lawsuit she filed last year, while Araiza agreed to dismiss his defamation countersuit against her, his attorneys said in a statement.

He’ll be removed from the suit in the next week, won’t pay any money to the woman and reserves the right to sue her attorney for harm caused, the statement said, terming the agreement “bittersweet.”

“Matt has been forced to defend himself for the last sixteen months against false accusations and a campaign to ruin his career in the NFL. He will never get this time in his life back,” attorneys Dick Semerdjian and Kristen Bush said.

“Thankfully, there was extensive evidence that was key to securing Matt’s voluntary dismissal from this lawsuit,” the statement added. “Matt was and has always been innocent. The case is over, and Matt has prevailed.”

Araiza said Wednesday that the ordeal has “changed me a lot” and that he wants another shot at the NFL.

“My name, my reputation — this will be tied to me forever, that won’t go away,” he said at a news conference. “It was tough to watch the pain that it caused my family, because I have been proven innocent but they for sure had absolutely nothing to do with this.”

Araiza said he continues to work out.

“When I was cut, I was an NFL starter, had just beat out an NFL veteran. I was on a four-year contract and that wont be handed back to me. No one in the NFL is going to go, ‘Here’s the job that you once had,’ so working to regain where I was at is my primary goal right now,” Araiza said. “I’m confident that I will be able to regain my NFL career — whenever that is. I believe it’s more of a when, not an if.”

The defamation lawsuit against the woman, described in court documents only as Jane Doe, was “legally baseless,” but her first legal bill topped $20,000 and she “simply cannot afford to defend herself,” her attorney, Dan Gilleon, said in a statement reported by the San Diego Union-Tribune.

“Plus she has been beat down by Araiza’s PR campaign and is frankly over it,” he said in a text, the news outlet reported.

The lawsuit against four other former San Diego State University players will continue.

An email from The Associated Press seeking comment from Gilleon wasn’t immediately answered Tuesday night.

Araiza was nicknamed the “Punt God” and honored as a consensus All-American in 2021 for his booming kicks that helped SDSU to a school-best 12-2 season in his senior year. He was selected by the Bills in the sixth round of the 2022 NFL draft but released two days after the filing of the lawsuit.

The woman alleged that she was 17 and attending an off-campus party in October 2021 when Araiza, then 21, had sex with her in a side yard at an off-campus house before bringing her into a bedroom where a group of men took turns raping her. She reported the alleged assault to San Diego police the next day.

Araiza has said he stayed in the backyard and never entered the home during the party and that he left nearly a half-hour before the alleged raping occurred.

He and most of the other players the woman is suing have said their encounters with her were consensual.

After a monthlong police investigation, the San Diego County District attorney’s Office announced in December that it would not file criminal charges. Several media outlets obtained an audio recording of a meeting between prosecutors and the woman in which deputy District attorney Trisha Amador said she concluded, based on a witness statement, that Araiza “wasn’t even at the party anymore” when the alleged raping could have occurred and wasn’t visible in videos that were recovered.

Earlier this year, the New York Jets hosted Araiza for a workout at the team’s facility, six days after a San Diego State investigation found no wrongdoing by him in connection with the alleged rape.
