California attorney General Rob Bonta says that the new rules would strengthen penalties for all voice-service providers who don’t provide a plan to minimize illegal robocall traffic through their services.

CALIFORNIA – California attorney General Rob Bonta joined a coalition of 47 Attorneys General in submitting a comment letter to the Federal Communications Commission.

In the letter, all of the Attorneys General showed their support for proposed rule changes that would help boost the FCC’s robocall mitigation defense.

The news rules would strengthen penalties for all voice-service providers who fail to provide a plan to minimize illegal robocall traffic through their services.

Bonta says that the new rules will help play a big role in the fight against unwanted robocalls.

Attorneys for former President Trump and his Georgia co-defendants made their final pitch Friday to disqualify Fulton County District attorney Fani Willis (D), attacking her credibility and motives given her romantic relationship with a top prosecutor. 

After listening to three hours of legal arguments, Judge Scott McAfee indicated he hoped to issue a ruling in the next two weeks. 

“I think it has been very much made clear by the argument made today … that there are several legal issues to sort through, several factual determinations that I have to make,” McAfee said. “And those aren’t ones I can make at this moment. And so, I will be taking the time to make sure that I give this case the full consideration it’s due.”

The judge is now tasked with determining whether Willis and her office should be blocked from continuing to prosecute Trump and his allies, a decision that will dictate the future of the historic election interference case in Georgia. Trump pleaded not guilty to the charges as well as his three other criminal indictments. 

Friday’s arguments capped a battle that has now lasted nearly two months over whether Willis’s romance with special prosecutor Nathan Wade amounted to a conflict of interest. Both now acknowledge the relationship, but have described the calls to step away as meritless. 

“The motion to disqualify should be denied. And Ms. Willis, as the district attorney of Fulton County, and Mr. Wade, as the special prosecutor assigned to this case, should be allowed to remain on this case and continue to prosecute the case,” Adam Abbate, the county’s chief deputy district attorney, said on behalf of the state. 

Defense attorneys argued that McAfee only needed to find an appearance of a conflict to disqualify Willis, while the state contended an actual conflict is necessary. The judge previously said he could consider both methods of weighing the evidence and his ruling could hinge on which method he chooses.  

“Do you have to find that Wade and Willis lied? No,” Steve Sadow, Trump’s lead attorney in the case, told the judge. 

“What you need to be able to find is that there is a concern of a legitimate concern based on the evidence in this case, about their truthfulness,” Sadow continued. “A legitimate concern about the truthfulness, which equates to an appearance of impropriety.” 

Fulton County prosecutors countered that the appearance of impropriety is “not the standard” in Georgia.   

“The defense has to show an actual conflict, and in this instance, they have to show that the actual conflict would be that Ms. Willis received a financial benefit or gain and…got it based upon the outcome of the case,” Abbate said.  

The defense purports that Willis and Wade did not testify truthfully under oath about the timeline of their relationship. While the prosecutors said they began dating in early 2022, defense attorneys contend their relationship started years earlier — before Wade was hired to prosecute Trump. 

Testimony from an ex-friend of Willis’, Robin Yeartie, and text messages from Wade’s former law partner, Terrence Bradley, align with defense attorneys’ suggestion the relationship began in 2019, after a judicial conference.

Yeartie said Willis and Wade “no doubt” began dating in 2019, while Bradley — in text messages with defense attorney Ashleigh Merchant, who filed the original motion to disqualify the prosecutors — said their relationship “absolutely” began that year.  

However, Bradley described his texts as “speculation” on the witness stand, drawing his credibility into question. Sadow, Trump’s attorney, urged the judge to take Bradley’s private communications, not his testimony, at face value.  

“Now, ‘absolutely’ is not a speculative word,” Sadow said. “That’s not speculation; that’s a definitive statement.” 

Prosecutors, meanwhile, described Bradley as a “disgruntled, vengeful speculator” and similarly attacked the credibility of the defense’s other witnesses.

John Merchant, an attorney representing Trump co-defendant Michael Roman, told the judge he can “separate the wheat from the chaff when it comes to credibility.” 

“If you look at everything put together, judge, they did this, they knew it was wrong, they hid it, and even when they were called out on it, they tried to create an excuse for it by saying it happened after the fact,” Merchant said.

Even if the judge did find that prosecutors lied, it’s still unclear he would go as far to disqualify them, however. 

“Where in the law do we find the remedy to an untruthful statement,” McAfee pressed the defense Friday. “Generally, we send you down the street to the bar.”

VENICE, Fla. (WFLA) — The attorney for Gabby Petito’s family says Brian Laundrie’s parents have admitted what their son told them in the days after killing his 22-year-old fiancé in August 2021.

During depositions for the upcoming civil trial between the two families, Chris and Roberta Laundrie said in a “frantic” phone call on Aug. 29, 2021, two days after Petito was believed to have been murdered, that their son informed them that Petito was “gone” and that he needed a lawyer, according to Petito attorney Pat Reilly.

Reilly said Chris and Roberta Laundrie did not admit to knowing Petito had been killed, only that they were told by Brian Laundrie that she was “gone.”

According to court documents and the depositions, Chris and Roberta Laundrie then informed their longtime lawyer Steven Bertolino that Petito was “gone” and that Brian Laundrie was in need of an attorney. A retainer was sent to him six days later.

Reilly said he believes the Laundries, and possibly Bertolino, were told more. He has filed a motion to force Bertolino to reveal what Brian Laundrie told him. A hearing on the motion and whether Brian Laundrie’s attorney-client privilege should be upheld is scheduled for Dec. 20 in Florida’s Sarasota County Circuit Court.

“I want to know what [Brian Laundrie] told Bertolino,” Reilly told Nexstar’s WFLA. “He probably admitted more. And did [Bertolino] know where Gabby’s body was located?”

Ryan Gilbert, the attorney representing the Laundries in the Petito civil suit, has not responded to a request for comment. Bertolino declined to comment.

‘Burn after reading’ letter: Brian Laundrie’s mother offered shovel, garbage bags to dispose of body if needed

According to the court documents, the Petito family alleges that in the aftermath of Petito’s killing, Brian Laundrie used Petito’s phone to send text messages to her family in an attempt to deceive them. Among the messages sent, Brian Laundrie is believed to have sent a text to Petito’s mother, Nichole Schmidt, about Gabby Petito’s grandfather and referred to him as “Stan.” Schmidt has stated that Gabby Petito never called her grandfather by his first name and that the text was highly suspicious.

Schmidt and Joe Petito, Gabby Petito’s father, have sued the Laundries and Bertolino for intentional infliction of emotional distress, claiming they were aware Gabby Petito was dead but chose to do nothing other than release a statement expressing hope that she would be found.

After several postponements, the trial is scheduled for May 2024.

Lucio Soria has survived 28 years covering crime in one of Mexico’s most violent cities

JUAREZ, Mexico (Border Report) – News photographers like Lucio Soria have developed common-sense safety protocols to cover crime in a city with one of the highest homicide rates in the world.

Be aware of your surroundings. Do your job quickly and get out. Don’t upset anyone at crime scenes where emotions are running high. And don’t name names.

“It has always been dangerous,” said Soria, a 28-year veteran of the Juarez police beat for various newspapers and news portals. “Just remember you are a reporter, not a policeman. Often you want names or other information that gets you in trouble with the family, or maybe the victim is the relative of a drug trafficker. It’s better to be calm, do your job and leave.”

Mexico in 2022 buried 15 working journalists who met a violent death presumably at the hands of criminals. This year, five active or recently retired newsmen have been killed, according to a detailed list published by El Universal.

Soria has been in the eye of the storm since the 1990s and documented crime during Juarez’s most violent periods – the mid- and late 2000s. That’s when the Sinaloa cartel came in, guns blazing, to take over the plaza from a Juarez cartel that never overcame the death of its leader, Amado Carrillo Fuentes, aka “The Lord of the Skies.” Amid the chaos, extortion and kidnapping grew rampant, according to think-tanks like The Wilson Center.

Soria’s photos show feet hanging out of 55-gallon metal drums, rows of four, five, six bodies laying on a single street, and police officers picking up trash bags stuffed with severed heads, arms and legs. Others he took from atop roofs, between a crowd of people or out in the middle of the desert.

“I always took the best photos, the best angles. First you show people where this is happening; you use a wide lens. Then you get the details, capture the deceased. Then the reactions of the moms, relatives and the cops” trying to control the crowd, the photojournalist said.

Residents, journalists got used to the horror

Soria, 71, who started out as a lab technician at a photo studio when cameras still used film, acknowledged feeling odd at first when photographing young men’s bodies while their relatives cried and screamed in horror in the background. But news about crime sells and employers demanded the most impactful shots from him, so he had to get used to the mayhem.

He wasn’t the only one. Nowadays, it’s common even for street vendors to approach crime scenes in Juarez and peddle bottled water and chips to police officers and onlookers, he said.

Homicides remain a daily occurrence. Juarez last year recorded around 1,200 homicides, with some 1,400 in 2021 and 1,600 in 2020, according to Municipal Police Chief Cesar Omar Munoz.

In August, Juarez recorded 109 homicides, Chihuahua attorney General Cesar Jauregui said.

The photos that don’t focus on bodies, though, are among the ones he remembers most. There’s one showing a couple holding up a distraught older woman who just saw her child dead on the street. Another shows a police officer taking a photo of a car with dozens of bullet holes on its windshield. No caption is necessary.

Soria said he has photographed more than 3,000 homicide scenes in his career and refers to them as “events.”

“One day I photographed 30 deaths. The events began at 7 a.m. It was four to five people at a time. It began with four people inside a very pretty car in front of a convenience store,” he said. “Then there were three more and then four at the Mexico 68 neighborhood. I had to go up on the roof because the bodies were in the backyard. Then we went to (another neighborhood) and there was another four inside a truck. There were more. It was a super violent day.”

And while the number of homicides in Juarez today are about 50% of what they were during the height of the Sinaloa-Juarez conflict, they seem to be more brutal now.

“They chop up the bodies because they owed a lot of money or they killed (somebody’s) relatives. To me, the (severed) trunks, limbs, even testicles are now normal, but what gets me is when (the forensic team) begins to put together the pieces on the ground,” he said, adding that ends his detachment from the reality of the moment.

Soria, who is taking a respite from photojournalism due to health problems, said his legacy includes his work and having mentored many young photojournalists over the years. “I never had a problem with anyone. If someone needed help, I was always there for them,” he said.

Soria said he sees no end in sight for the drug violence that took hold of the city since the mid-1990s. Not as long as there’s a demand for the drugs in the U.S. and Mexico and people believe they can cash in on the illicit trade.

Idalia strengthens over warm Gulf of Mexico waters as it steams toward Florida

CEDAR KEY, Fla. (AP) — Florida residents living in vulnerable coastal areas were ordered to pack up and leave Tuesday as Hurricane Idalia gained steam in the warm waters of the Gulf of Mexico and threatened to unleash life-threatening storm surges and rainfall.

Idalia also pummeled Cuba with heavy rains on Monday and Tuesday, leaving the tobacco-growing province of Pinar del Rio underwater and many of its residents without power.

Idalia had strengthened to a Category 2 system on Tuesday afternoon, with winds strengthening to 105 mph (165 kph) by Tuesday evening. The hurricane was projected to come ashore early Wednesday as a Category 3 system with sustained winds of up to 120 mph (193 kph) in the lightly populated Big Bend region, where the Florida Panhandle curves into the peninsula. The result could be a big blow to a state still dealing with lingering damage from last year’s Hurricane Ian.

The National Weather Service in Tallahassee called Idalia “an unprecedented event” since no major hurricanes on record have ever passed through the bay abutting the Big Bend.

On the island of Cedar Key, Commissioner Sue Colson joined other city officials in packing up documents and electronics at City Hall. She had a message for the almost 900 residents who were under mandatory orders to evacuate. More than a dozen state troopers went door to door warning residents that storm surge could rise as high as 15 feet (4.5 meters).

University of North Carolina graduate student left building right after killing adviser, police say

CHAPEL HILL, N.C. (AP) — A University of North Carolina graduate student walked into a classroom building, shot his faculty adviser and quickly left, authorities said a day after the attack paralyzed campus as police searched for the gunman.

Tailei Qi, 34, was charged Tuesday with first-degree murder and having a gun on educational property in Monday’s killing of Zijie Yan inside a science building at the state’s flagship public university.

Chapel Hill police arrested Qi without force in a residential neighborhood near campus within two hours of the attack, UNC Police Chief Brian James said at a news conference.

Investigators were trying to determine a motive and searching for the gun, James said. He declined to specify where in Caudill Labs Yan was killed, saying officers are still looking at evidence. Qi was already gone when a team of officers reached the building, James said.

Yan was “a beloved colleague, mentor and a friend of so many on our campus and a father to two young children,” UNC Chancellor Kevin Guskiewicz at the news conference.

10 drugs targeted for Medicare price negotiations as Biden pitches cost reductions

WASHINGTON (AP) — President Joe Biden touted the potential cost savings of Medicare’s first-ever price negotiations for widely used prescription drugs on Tuesday as he struggles to convince Americans that he’s improved their lives as he runs for reelection.

The drugs include the blood thinner Eliquis, diabetes treatment Jardiance and eight other medications. The negotiation process was authorized under the Inflation Reduction Act, which Biden signed last year, capping decades of debate over whether the federal government should be allowed to haggle with pharmaceutical companies.

Any lower prices won’t take effect for three years, and the path forward could be further complicated by litigation from drugmakers and heavy criticism from Republicans.

But the effort is a centerpiece of Biden’s reelection pitch as the Democrat tries to show Americans he’s deserving of a second term because of the work he’s doing to lower costs while the country is struggling with inflation. The drug negotiations, like many of Biden’s biggest policy moves, will take time to play out, and his challenge is to persuade the public to be patient.

“For all of you out there, I get it, and millions of Americans get it,” Biden said at the White House. “I promise you. I’m going to have your back and I’ll never stop fighting for you on this issue.”

HBCU president lauds students, officer for stopping Jacksonville killer before racist store attack

JACKSONVILLE, Fla. (AP) — A campus security officer tipped off by observant students likely stopped the killer who fatally shot three people at a nearby Dollar General Store from carrying out his racist attack at Edward Waters University, the president of the historically Black institution said Monday.

Students reported seeing a young, white man, pull into a campus library parking lot in Jacksonville, Florida, and begin putting on tactical gear Saturday, Edward Waters University President Zachary Faison Jr. said. They immediately flagged down a security officer who was on patrol to tell them what they saw.

The officer approached the car on foot when the driver — who would later be identified as the shooter at the store — sped off, hitting a curb and narrowly avoiding a brick column, Faison said. The campus officer, who the campus president called a hero, then called the Jacksonville Sheriff’s Office and shared the description of the vehicle.

Minutes later, the gunman made his way to a Dollar General Store down the road and killed Angela Michelle Carr, 52, an Uber driver who was shot in her car; store employee A.J. Laguerre, 19, who was shot as he tried to flee; and customer Jerrald Gallion, 29, who was shot as he entered the store in the predominantly Black New Town neighborhood. The gunman killed himself after the murders.

“It’s not just on a whim that he chose to come to Florida’s first historically Black college or university,” said Faison, who expressed condolences to the families of the victims and confirmed none were part of the university.

GUATEMALA CITY (AP) — Guatemala’s Aug. 20 presidential election has been bogged down in court and legal challenges despite the fact the results were clear: Progressive candidate Bernardo Arévalo won about 61% of the vote to conservative Sandra Torres’ 39%. After weeks of uncertainty, the top electoral court finally certified Arévalo as the winner Monday.

But federal prosecutors are seeking to suspend his party, throwing into doubt whether he will have any support in congress. And Torres has filed court challenges seeking to overturn the election result, alleging fraud in the vote count — something none of the independent election observer groups reported.

How did it get so complicated?

Governmental corruption and impunity was so bad in Guatemala that in 2006 the country had to call in a United Nations-backed commission, known as CICIG, to combat it.

The commission’s work led to some serious results: In 2015, Guatemala became one of the few countries in the world to force a sitting president, Otto Pérez Molina, to resign and immediately go to jail, along with his vice president.

Lawyers indicted with Trump say they were doing their jobs. But that may be a tough argument to make

WASHINGTON (AP) — As John Eastman prepared to surrender to Georgia authorities last week for an indictment related to efforts to overturn the 2020 presidential election, he issued a statement denouncing the criminal case as targeting attorneys “for their zealous advocacy on behalf of their clients.”

Another defendant, Rudy Giuliani, struck a similar note, saying he was being indicted for his work as Donald Trump’s attorney. “I never thought I’d get indicted for being a lawyer,” he lamented.

The 18 defendants charged alongside Trump in this month’s racketeering indictment in Fulton County include more than a half-dozen lawyers, and the statements from Eastman and Giuliani provide early foreshadowing of at least one of the defenses they seem poised to raise: that they were merely doing their jobs as attorneys when they maneuvered on Trump’s behalf to undo the results of that election.

PETERSBURG, Russia (AP) — A private burial was held for Yevgeny Prigozhin, ending a tumultuous journey from St. Petersburg street thug to Kremlin-financed mercenary leader, following a suspicious plane crash two months after his brief mutiny that challenged the authority of President Vladimir Putin.

His spokespeople said Tuesday a service took place behind closed doors, and directed “those who wish to bid their farewell” to the 62-year-old head of the Wagner private military contractor to go to the Porokhovskoye cemetery in his hometown. Their statement ended media speculation on where and when Prigozhin would be laid to rest, with his funeral shrouded in secrecy.

A wooden cross towered over his flower-covered grave. Nearby stood a Russian tricolor and a black Wagner flag. Russian media cited unidentified sources as saying Prigozhin was laid to rest Tuesday without any publicity, per his family’s wishes.

Members of the Russian National Guard were stationed along the fence at the cemetery, steering visitors away after it closed for the day.

Putin’s spokesman said the president would not attend the service. The Russian leader had decried the armed rebellion in June as “treason” and “a stab in the back.”

No. 2 House Republican Steve Scalise is diagnosed with blood cancer and undergoing treatment

WASHINGTON (AP) — Rep. Steve Scalise, the No. 2 House Republican, said Tuesday he has been diagnosed with a form of blood cancer known as multiple myeloma and is undergoing treatment.

Scalise, 57, said he will continue to serve in the House. He described the cancer as “very treatable” and said it was detected early.

The Louisiana Republican was among several people wounded in 2017 when a rifle-wielding attacker fired on lawmakers on a baseball field in Alexandria, Virginia, outside Washington. Scalise was shot in the hip and endured lengthy hospitalizations, multiple surgeries and painful rehabilitation.

The cancer diagnosis came, Scalise said, after he had not been feeling like himself in the past week. Blood tests showed some irregularities and after additional screening, he said he was diagnosed with multiple myeloma.

“I have now begun treatment, which will continue for the next several months,” Scalise said in a statement. “I expect to work through this period and intend to return to Washington, continuing my work as Majority Leader and serving the people of Louisiana’s First Congressional District.”

NORFOLK, Va. (AP) — The U.S. government is trying to stop a planned expedition to recover items of historical interest from the sunken Titanic, citing a federal law and an international agreement that treat the shipwreck as a hallowed gravesite.

The expedition is being organized by RMS Titanic Inc., the Georgia-based firm that owns the salvage rights to the world’s most famous shipwreck. The company exhibits artifacts that have been recovered from the wreck site at the bottom of the North Atlantic, from silverware to a piece of the Titanic’s hull.

The government’s challenge comes more than two months after the Titan submersible imploded near the sunken ocean liner, killing five people. But this legal fight has nothing to do with the June tragedy, which involved a different company and an unconventionally designed vessel.

The battle in the U.S. District Court in Norfolk, Virginia, which oversees Titanic salvage matters, hinges instead on federal law and a pact with Great Britain to treat the sunken Titanic as a memorial to the more than 1,500 people who died. The ship hit an iceberg and sank in 1912.

The U.S. argues that entering the Titanic’s severed hull — or physically altering or disturbing the wreck — is regulated by federal law and its agreement with Britain. Among the government’s concerns is the possible disturbance of artifacts and any human remains that may still exist.

It has been well over 100 days since members of the Writers Guild of America stopped working, and more than a month since the actors union joined them. LeBlanc’s is just one story of many detailing the financial ripple effects.
