AND WHILE WALLACE IS ARGUING SELF-DEFENSE, HAAS SAYS THAT’S A PARTICULAR CLEARLY DIFFICULT ARGUMENT TO USE WHEN IT’S AGAINST A LAW ENFORCEMENT OFFICER. THERE’S A SITUATION OUTSIDE OF MY CONTROL. YOU KNOW, I JUST DID WHAT I COULD TO SURVIVE THE ENCOUNTER BECAUSE I DIDN’T KNOW HOW IT WAS GOING TO END FOR ME. AFTER THIS IS THE ARGUMENT OTO WALLACE MADE WHEN HE TOOK THE STAND ON THURSDAY, ARGUING HE ACTED IN SELF-DEFENSE WHEN HE SHOT AND KILLED 26 YEAR OLD DAYTONA BEACH POLICE OFFICER JASON RAYNOR IN 2021. I FELT IN THAT MOMENT THERE WAS NO OTHER WAY I CAN GET OUT OF THIS SITUATION. DEFENSE attorney DAVID HAAS SAYS IT’S A DIFFICULT DEFENSE TO MAKE. THAT’S JUST A HIGH BAR WITH A POLICE OFFICER WHO’S, YOU KNOW, ENGAGED IN LAWFUL CONDUCT OF DOING JUST OFFICER PATROL. SO IT DOESN’T MEAN THAT THE DEFENSE CAN’T REACH THAT, BUT IT IS GOING TO BE A TOUGH SELL TO TO THE JURY. ANOTHER OBSTACLE FOR THE DEFENSE, HAAS SAYS THE BODY WORN CAMERA FOOTAGE OF WALLACE AND RAYNOR’S ENCOUNTER. YOU KNOW, OFFICER RAYNOR APPROACHING MR. WALLACE AND IMMEDIATELY MR. WALLACE SORT OF GETTING OUT OF THE CAR AND OFFICER ANDERSON GET BACK IN THE CAR. HE PUTS HIS HAND ON HIM AND STARTS TO PUSH HIM IN. AND THEN YOU JUST HEAR SORT OF THIS, YOU KNOW, SCRUFF THAT OCCURS. HAAS SAYS THE DEFENSE WOULD HAVE TO PROVE RAYNOR WAS USING. EXCESSIVE FORCE, BUT THE VIDEO DOESN’T APPEAR TO SHOW THAT. THERE’S NO EVIDENCE. THERE’S REALLY NO INDEPENDENT EVIDENCE AS GUNS IN THIS HOLSTER THAT HE WAS USING DEADLY FORCE. AND SO THAT, I THINK, IS GOING TO BE THE BIGGEST ISSUE FOR THE DEFENSE TO TRY TO OVERCOME. IF WALLACE IS FOUND GUILTY, PROSECUTORS SAY THEY WILL SEEK THE DEATH PENALTY. SO I ASKED HAAS IF HE THINKS THE SAME JURY THAT SAT THROUGH THE TRIAL WILL ALSO BE USED FOR THE SENTENCING. Othal Wallace took the stand on Thursday and testifed he acted in self-defense when he shot and killed 26-year-old Daytona Beach police officer Jason Raynor in 2021.

“There was a situation outside of my control. I just did what I could to survive this encounter because I didn’t know how it was going to end for me. I felt in that moment there was no other way I could get out of this situation,” he said.
