Bay Area civil rights attorneys have called for an emergency meeting with the federal judge at the United States District Court for the Northern District of California in San Jose alleging that Immigration and Customs Enforcement officials in San Francisco are violating a court order issued in November requiring them to improve conditions at its immigration holding cells downtown. 

Attorneys with the Lawyers’ Committee for Civil Rights of the San Francisco Bay Area verbally notified Judge Casey Pitts on Tuesday alleging that ICE officials have simply moved detainees from the sixth floor of 630 Sansome St., the ICE headquarters in San Francisco that has multiple holding cells, down to the fifth floor as a means to elude the injunction.

“We have some reports that what the government has done is, rather than implement any part of the injunction, close the sixth floor of 630 Sansome,” said Marissa Hatton, a lead attorney on the case. ICE officials subsequently moved detained immigrants down to the fifth floor, she said, which the attorneys allege is also not designed to hold people.

The Trump administration lawyers denied the workaround. In Pitts’ courtroom, a government attorney said that the allegation came as a “surprise.” 

“This is the first time that I’m hearing of this,” he said. After a brief pause, he added: “I’m going to be crystal clear, we are not not complying with the orders.”

The lawsuit that prompted the preliminary injunction challenged ICE’s practice of holding immigrants longer than 12 hours and detailed the conditions they are allegedly experiencing: freezing temperatures, lack of privacy and loss of access to vital medications, personal belongings, and other essentials. Pitts on Nov. 25 ordered those conditions remedied.

Attorneys from the Lawyers’ Committee and partnering firms, including the ACLU, contested the government’s claim that it was complying with the judge’s order. Hatton told Mission Local that the relocation one floor down is a government attempt to “circumvent” the injunction, which applies to the entire building. She added, “The order was clear that the judge was enjoining all activities at 630 Sansome,” not just its sixth floor.

Hatton said the judge indicated he would take the matter seriously and told attorneys he could be available within 24 hours to discuss the development.

While courthouse arrests have slowed, multiple sources have confirmed recent arrests at routine ICE check-ins at 630 Sansome. These include three cases from last week: two people arrested during ICE check-ins and one arrested at their Bay Area home. 

One individual is confirmed to be an elderly woman, previously interviewed by Mission Local, who fell victim to an immigration scam and no longer had funds to hire an attorney for her case.

All three have since been processed through the fifth-floor holding cells.

Hatton said, “It is unconstitutional to hold people in inhumane conditions. It does not matter if you are on the fifth or sixth floor.”

A federal judge and a handful of attorneys representing some ICE detainees spent more than four hours Thursday inside the ICE processing facility in Broadview.

Their rare glimpse inside comes on the heels of a federal lawsuit, filed in late October, were attorneys for some of the detainees allege the building is a “black hole” and that there have been “inhumane conditions” here – with overcrowded holding cells, clogged toilets, and allegations of inadequate food and water. They also allege some detainees have been mistreated or coerced by ICE agents into signing their own deportation documents.

The group of visitors entered the building around 11:08 a.m. Thursday morning and left shortly before 3:30 p.m. without speak with reporters afterwards.

An ICE deputy official, Shawn Byers, was expected to lead the tour inside. Attorneys representing some of the detainees held here said ahead of Thursday’s site visit that  they wanted to examine holding cells and look at detention logs to better understand who was kept here and for how long.

Federal Judge Robert Gettleman has already said that the conditions as alleged sounded “cruel” and possibly “unconstitutional” and that the processing facility has acted more like a jail during the past eight weeks of the Trump administration’s immigration crackdown here in the Chicago area.

Gettleman did not tour the facility Thursday; instead, Federal Judge Laura McNally was expected to be part of the tour as she is helping Gettleman with the case as he is presiding over a separate and unrelated federal jury trial this week.

The Department of Homeland Security has pushed back against some of the allegations raised in the Broadview lawsuit, however, saying previously that any assertion that conditions at the facility are sub-prime are false.

In their lawsuit, attorneys representing some of the immigration detainees held here have argued that the conditions are poor, that the cells are overcrowded, with clogged toilets, inadequate food and that attorneys have a lack of access to their clients. They’ve also alleged that detainees have been mistreated, and that some were coerced into signing their own deportation documents.

NBC 5 Investigates spoke to a man last month – Eder Nicolas Jimenez Barrios – now deported to Mexico – who is not involved in the lawsuit,  but said he signed deportation documents after an ICE agent at the Broadview facility told him he could see an immigration judge but he’d kept in jail for 6 months until that time.

But since a judge issued a temporary restraining order aime d at improving conditions here, the government has said it has brought in bedding for detainees, cleaned bathrooms and repaired showers. 

They’ve also added additional phone lines and new email addresses aimed at improving communications.

NBC 5 Investigates did see what appeared to be ICE agents or security bringing in at least one detainee during our time here today. We have been told the census here is dramatically down from where it was. The max capacity is around 230 people, according to previous inspection records.

After the visit, a joint statement was issued by MJC, ACLU-IL, and Eimer Stahl of Chicago:

“We are grateful that the court gave us an opportunity to inspect the Broadview facility. We remain committed to ensuring that any detainees at Broadview are treated with dignity, have access to counsel, and are provided due process. We will reserve any detailed observations for our legal filings and presentations in the weeks ahead. We encourage anyone detained at Broadview and lawyers facing complications communicating with their clients at the facility to let us know about problems at the facility.”

As a small group of protesters flanked a street leading to the U.S. Immigration and Customs Enforcement processing center in Broadview, a group of attorneys on Thursday completed a tour of the building, becoming some of the only outsiders in recent months to view the interior amid scrutiny over allegedly inhumane conditions.

The rare site visit was ordered by U.S. Magistrate Judge Laura McNally — who also attended the tour — in the wake of a class-action lawsuit alleging dirty, unsafe and overcrowded conditions at the west suburban facility. The complaint, filed on behalf of two former detainees, additionally accused officials of blocking access to attorneys while coercing detainees into agreeing to voluntary deportation.

In a statement following the visit, the attorneys said they will save “detailed observations” about the visit for upcoming legal filings and presentations.

McNally’s ruling allowing the visit was a significant win for the plaintiffs in an atmosphere in which immigration attorneys, members of Congress and faith leaders have all been turned away from the building, called a “black box” in the lawsuit. The attorneys could be seen entering the building a little after 11 a.m. and leaving after 3 p.m.

“We are grateful that the court gave us an opportunity to inspect the Broadview facility. We remain committed to ensuring that any detainees at Broadview are treated with dignity, have access to counsel, and are provided due process,” said the statement, made jointly by attorneys for MacArthur Justice Center’s Illinois Office, the ACLU Illinois and Eimer Stahl law office. “We encourage anyone detained at Broadview and lawyers facing complications communicating with their clients at the facility to let us know about problems at the facility.”

After a daylong hearing during which detainees testified about more than 100 people crammed into a holding cell with no room to lay down, U.S. District Judge Robert Gettleman found that conditions there do not “pass constitutional muster” and ordered a temporary restraining order that requires the Department of Homeland Security to provide bedding, clean spaces, soap and showers and enough food and water for detainees housed overnight.

With those requirements in place, attorneys for the plaintiffs were granted an inspection to verify that the order is being followed and gather evidence.

They were allowed to take photographs and talk to detainees during the tour, as well as bring in a translator and detention expert.

Outside the building Thursday morning, a woman livestreamed the visit on her phone, as onlookers waited for the group to walk inside.

Near an altar honoring Silverio Villegas-Gonzalez, who was shot and killed by ICE agents following a Sept. 12 traffic stop, protesters held signs proclaiming: “No more ethnic cleansing” and “Your mama is not proud of you!!!”

“Did you hide all the evidence before the judge came?” one protester shouted.

Immigration attorneys testified that they have not been allowed into the building to visit with clients, and have even had significant difficulties connecting with them by phone and even learning where they are housed.

In June, U.S. Reps. Jesús “Chuy” García, Delia Ramirez, Jonathan Jackson and Danny Davis were denied entrance.

Clergy members who have historically ministered to detainees have also been denied access.

Pope Leo XIV even weighed in, calling on the Trump administration to allow detainees to take communion.

Meanwhile, Gov. JB Pritzker celebrated the drawing down of immigration agents in Chicago, even as he acknowledged the uncertainty of what comes next. The Tribune reported earlier this week that Border Patrol Cmdr. Gregory Bovino was set to leave Chicago after a period of violent and chaotic arrests and clashes with community members.

“We’ll see what comes next, but I am not confident, I’ll be honest with you, that we’re going to see peace in our neighborhoods now,” he said. “I think there are just fewer agents, and that will probably ratchet it down to some degree. But I think unless they change their tactics, they’re going to end up in court again and again and again.”

Immigration attorneys testified that they have not been allowed into the building to visit with clients, and have even had significant difficulties connecting with them by phone and even learning where they are housed.

In June, U.S. Reps. Jesús “Chuy” García, Delia Ramirez, Jonathan Jackson and Danny Davis were denied entrance.

Clergy members who have historically ministered to detainees have also been denied access.

Pope Leo XIV even weighed in, calling on the Trump administration to allow detainees to take communion.

Meanwhile, Gov. JB Pritzker celebrated the drawing down of immigration agents in Chicago, even as he acknowledged the uncertainty of what comes next. The Tribune reported earlier this week that Border Patrol Cmdr. Gregory Bovino was set to leave Chicago after a period of violent and chaotic arrests and clashes with community members.

“We’ll see what comes next, but I am not confident, I’ll be honest with you, that we’re going to see peace in our neighborhoods now,” he said. “I think there are just fewer agents, and that will probably ratchet it down to some degree. But I think unless they change their tactics, they’re going to end up in court again and again and again.”

San Francisco attorneys asked a federal judge on Monday to halt the practice of keeping immigrants detained for up to three days in holding cells across the country while they await transfer to long-term detention centers.

The attorneys, who represent four immigrants held in San Francisco holding cells, say conditions inside the cells are so poor that they violate immigrants’ constitutional rights.

The demand was the first major action in a hearing that kicked off Monday after the American Civil Liberties Union joined with other groups to sue Immigration and Customs Enforcement over conditions in its holding cells at 630 Sansome St., the city’s ICE headquarters. 

attorney Nisha Kashyap, who is with the Lawyers’ Committee for Civil Rights of the San Francisco Bay Area, appeared before Judge Casey Pitts in the U.S. District Court for the Northern District of California in San Jose to ask for a pause to an ICE policy that allows the agency to hold immigrants for up to 72 hours in its holding cells.

ICE started that policy in June.

ICE uses holding cells in its facilities nationwide to detain immigrants before they are transferred to detention centers. Until June, ICE could only hold immigrants in those cells for 12 hours. ICE then issued a waiver that month to extend the cap to three days.

Mission Local subsequently documented an increase in immigrants being held at the San Francisco ICE holding cells for longer periods of time, including at least two who were held more than 72 hours.

The attorneys also asked the judge to order ICE to immediately improve conditions in its holding cells at 630 Sansome St., in San Francisco.

Immigrants who were detained by ICE there over the last six months say they were kept in small, cold spaces for up to six days without prescribed medication, access to restrooms, clean clothes, and other essentials. 

Plaintiffs allege that the Sansome Street facility was never meant for more than short stays, and that current practices violate immigrants’ constitutional rights.

In the lawsuit, those detained at Sansome provided firsthand testimony describing freezing temperatures, little or no privacy in single-room metal cells, lack of beds or blankets, and fluorescent lights left on continuously. 

In the hearing, attorney Marissa Hatton of the Lawyers’ Committee for Civil Rights said the holding cells can cause “serious psychological harm.”

One plaintiff said he told ICE that he needed his blood pressure medications, but he received no medical attention. As a result, he suffered a medical crisis that may have caused permanent brain damage, according to the lawsuit.

If the judge makes a ruling in the plaintiffs’  favor, these conditions will have to be improved.

The plaintiffs’ attorneys also sought to expand their case to cover all immigrants who had been detained at 630 Sansome St., or may be detained there in the future, by seeking class-action certification. 

“The four individuals who brought this lawsuit seek to represent and advocate on behalf of all the folks affected by this policy,” Kashyap said, adding that the certification would ensure that “not every single individual detainee has to come into court with their own individual lawsuit.”

The government’s attorney argued against the class-action certification, saying the experiences of those detained at Sansome are too different to satisfy the legal standard. The attorney also sought to dismiss the ask for a stay of the 12-hour waiver.

While Judge Pitts did not issue a ruling Monday, he said a decision would come soon, given the sensitivity of the lawsuit at hand.

Kashyap left the hearing cautiously optimistic.

“The government had the opportunity to rebut and they failed,” Kashyap said. “That’s significant, because I think it shows what’s happening in San Francisco is unconstitutional, and it mirrors what we’re seeing happening in New York and Chicago.”
