California’s attorney General cautioned school districts across the state that policies requiring employees to report transgender students to their parents violated the state’s constitution.

attorney General Rob Bonta issued a legal alert on Thursday that said the policies adopted by several Golden State school districts are unconstitutional and “detrimental” to the privacy, safety and well-being of transgender and gender-nonconforming students.

“We know what the data tells us — that 15% of transgender, gender non-conforming young people are kicked out of their home,” attorney General Rob Bonta told KCAL last week after the warning was issued Thursday.

“Another 10% are harmed physically by members of their direct family,” he added.

Bonta’s warning came amid an ongoing battle between the attorney general and the Chino Valley School District, which issued the policy in July after a 4-1 vote from the school board.

The policy mandates that staff members must notify parents if their children ask to go by a different name or pronouns; whether they ask to use bathrooms or participate in activities not aligned with their birth gender.

The Chino Valley district requires the students to be reported even if they haven’t given staff permission to disclose the information.

Bonta has insisted the policy discriminates against trans students and puts them in danger.

“He’s showing that he wants to be the parent of our children and he’s not doing his real job, which is keeping California safe,” Shaw told KCAL. “What is he doing to make them safe at campus by keeping parents out? It absolutely makes no sense.”

In his warning last week, Bonta’s office said the outing policies “target transgender and gender nonconforming students,” before highlighting three separate ways it violated the California constitution’s Equal Protection Clause, according to the Sacramento Bee.

“Because gender identity is an aspect of gender, transgender or gender nonconforming individuals constitute a protected class under California’s equal protection clause,” the notification read.

The mandate resulted in a fiery board of education meeting in July and outrage from both sides of the debate since. AP

Other violations included prohibitions against gender discrimination, pointing out how the “forced outing policies target one group, and ‘that group alone’ for discriminatory treatment,” along with violations of the students’ right to privacy.

“In sum, by singling out transgender and gender nonconforming students for different, adverse treatment that puts them at risk of harm, forced disclosure policies violate their constitutional right to equal protection and privacy, as well as their statutory protection from discrimination under California law,” the warning read.

Bonto’s office previously sued the school district to block the policy in August, which he called “hateful,” citing a fiery July 20 Board of Education hearing in which trans students were described as “perverse” and having “mental illness.”

Shaw has doubled down on the policy, characterizing it as a battle for parents’ rights against invasive liberal politicians who want to strip them away.

“The political cartel has continued to show their cards and I think we just need to stand with our constitutional rights and we need to make sure we protect our kids together,” she said on Thursday.

TULARE COUNTY, Calif. (FOX26) — A 17-year-old boy from Tulare County has made legal history by becoming the youngest person ever to pass the California bar exam, according to the Tulare County District attorney.

Law clerk Peter Park passed the difficult test on his first try at the age of 17.

Research shows that the previous record holder was an 18-year-old.

Park was 13 years old when he first started high school at Oxford Academy in Cypress, CA in 2019.

At the same time, Park also enrolled himself in a four-year juris doctor program at Northwestern California University School of Law.

He was able to do this by taking advantage of a state bar rule that allows any student to apply to law school after completing College Level Proficiency Exams.

He then graduated high school early in 2021 by taking the California High School Proficiency Exam.

He focused on law and graduated by 2023, officially becoming a law clerk with the Tulare County District attorney in August.

Park just recently turned 18 in late November and was officially sworn in on Tuesday, December 5 in Visalia.

He is now one of California’s youngest practicing attorneys.

He had this to say about his amazing accomplishment,

It was not easy, but it was worth it. It required discipline and strategy to pass the Bar, and I made it in the end. I am extremely blessed to have discovered this path, and my hope is that more people will realize that alternative paths exist to becoming an attorney. Ben Brody says his life was going fine. He had just finished college, stayed out of trouble, and was prepping for law school. Then, seemingly out of nowhere, Elon Musk used his considerable social media clout to amplify an online mob’s misguided rants accusing the 22-year-old from California of being an undercover agent in a neo-Nazi group.

The claim, Brody told CNN, was as bizarre as it was baseless.

But the fact he bore a vague resemblance to a person allegedly in the group, that he was Jewish, and, that he once stated in a college fraternity profile posted online that he aspired to one day work for the government, was more than enough information for internet trolls to falsely conclude Brody was an undercover government agent (a “Fed”) planted inside the neo-Nazi group to make them look bad.

For Brody, the fallout was immediate. Overnight, he became a central character in a story spun by people seeking to deny and downplay the actions of hate groups in the United States today.

The lies and taunts, which Musk engaged with on social media, turned his life upside down, Brody said. At one point, he said, he and his mother had to flee their home for fear of being attacked.

Now, he’s fighting back.

Brody filed a defamation lawsuit last month against Musk, the owner of X, formerly known as Twitter. The suit seeks damages in excess of $1 million. Brody says he wants the billionaire to apologize and retract the false claims about him.

Brody’s lawyer—who is the same attorney who successfully sued conspiracy theorist Alex Jones over his lies about the Sandy Hook Elementary School massacre —said he hopes the suit will force one of the world’s richest and most powerful men to reckon with his careless and harmful online behavior.

“This case strikes at the heart of something that I think is going really wrong in this country,” attorney Mark Bankston said in an interview with CNN. “How powerful people, very influential people, are being far too reckless about the things they say about private people, people just trying to go about their lives who’ve done nothing to cause this attention.”

Asked for comment on the lawsuit, an attorney for Musk told CNN “we expect this case to be dismissed.” Musk’s lawyers have until Jan 5, 2024, to file their response in court.

On the night of Saturday, June 24, 2023, Ben Brody was in Riverside, California.

About 1,000 miles away, a gay pride event was being held near Portland, Oregon. In recent years, the city has become a flashpoint for often violent clashes over the country’s ongoing culture wars.

It was no great surprise then that the event became a target for rival far-right groups and neo-Nazis who began fighting among themselves while protesting. Video of the skirmish, where the far-right protesters pushed and pulled at each other, quickly spread across social media.

Online conspiracy theorists soon jumped into the fray.

Rather than accept the fact that two far-right groups who have previously embraced violence were responsible for the clash, online trolls insisted it must be a so-called “false flag” event – a set-up of some kind to make the neo-Nazis look bad.

That’s when they found Ben Brody.

The day after the Pride event, Brody began getting text messages from his friends telling him to check out social media.

“You’re being accused of being a neo-Nazi fed,” he recalled some of his friends telling him.

Somehow, someone on social media had found a photo of Brody online and decided he looked like one of the people involved in the clash.

Anonymous people online, self-appointed internet detectives, began digging and found out Brody was Jewish and had been a political science major at the University of California, Riverside. On his college fraternity’s webpage, he had once stated he wanted to work for the government.

“I put that I wanted to work for the government. And that’s just because I didn’t know specifically what part of the government I wanted to work for. You know, I was like, I could be a lawyer,” Brody recalled in an interview with CNN.

His being Jewish was relevant to them because conspiracy theories are often steeped in antisemitism – suggesting there’s a Jewish plan to control the world.

Brody’s social media inboxes filled up with messages, such as “Fed,” “Nazi,” and “We got you.” He and his mom were forced to leave their family home after their address was posted online, he said.

Some of Brody’s friends began posting online, trying to correct the record and explain this was a case of mistaken identity. Brody himself posted a video to Instagram where he desperately tried to prove his innocence. He even went as far as getting time-stamped video surveillance footage showing him in a restaurant in Riverside, California, at the time of the brawl in Oregon, as proof he could not have been at the rally.

But to no avail. The conspiracy theory kept spreading across the internet, including on X. But it wasn’t just anonymous trolls fueling the lie. Musk, the platform’s owner, had joined in, amplifying the lie to his millions of followers.

Video from the Oregon event showed the masks of at least one protester being removed during the fight between the opposing far-right groups. Musk asked on X on June 25, “Who were the unmasked individuals?”

Another X user linked to a tweet alleging Brody was one of the unmasked individuals. The tweet highlighted a line from Brody’s fraternity profile that noted he wanted to work for the government after graduation.

The tweet claimed the unmasked alleged member of the far-right group was Brody, pointing out he was a “political science student at a liberal school on a career path towards the feds.”

“Very odd,” Musk responded.

Another user shared the tweet alleging Brody’s involvement and commented, “Remember when they called us conspiracy theorists for saying the feds were planting fake Nazis at rallies?”

“Always remove their masks,” Musk replied.

On June 27, having engaged with conspiracy theories about the subject over a number of days, Musk alleged that the Oregon skirmish was a false flag. “Looks like one is a college student (who wants to join the govt) and another is maybe an Antifa member, but nonetheless a probable false flag situation,” he tweeted.

“I knew that this was snowballing, but once Elon Musk commented, I was like, ‘boom, that’s the final nail in the coffin,’” Brody recalled.

Musk has more followers than anyone else on X – approximately 150 million at the end of June, around the time he tweeted about the fight in Oregon, according to records from the Internet Archive. That tweet has been viewed more than 1.2 million times, according to X’s own data.

Brody worried his name would forever be associated with neo-Nazism, that he wouldn’t be able to get a job. Though he had finished college, he hadn’t yet graduated, and he said some of the accounts messaging him were threatening to contact his university. “My life is ruined,” he thought.

Attempting to clear his name, he gave an interview to Vice.com, which caught the attention of Mark Bankston.

Bankston is best known as the lawyer who successfully took on the conspiracy theorist Alex Jones in court on behalf of parents who lost their children in the 2012 Sandy Hook school shooting.

Bankston said Brody’s case is not only an opportunity to help clear the young man’s name but could also force what he views as a necessary conversation about the vitriolic nature of online discourse.

The lawsuit filed last month in Travis County, Texas (the same county in which Bankston successfully sued Jones), alleges Musk’s claims about Brody are part of a “serial pattern of slander” by the billionaire.

Musk, the suit argues, is “perhaps the most influential of all influencers, and his endorsement of the accusation against Ben galvanized other social media influencers and users to continue their attacks and harassment, as well as post accusations against Ben that will remain online forever.”

Soon after he took over Twitter in 2022, Musk said the platform must “become by far the most accurate source of information about the world.”

But, on the contrary, the suit alleges, “Musk has been personally using the platform to spread false statements on a consistent basis while propping up and amplifying the most reprehensible elements of conspiracy-addled Twitter.”

The suit outlines how Musk has engaged with accounts that traffic in racism and antisemitism and lists instances in which he publicly shared or engaged with conspiracy theories – including last October when he shared false claims about the attack on Paul Pelosi, husband of then House Speaker Nancy Pelosi.

The suit alleges that in August after Musk was made aware through his lawyers about Brody’s case for defamation, Musk refused to delete his tweets.

Bankston and his client said the lawsuit is about a lot more than money.

“I just want to make things right,” Brody told CNN. “It’s not about vengeance. I’m not angry. It’s not resentment. I just want to make things right, to get an apology, so that this doesn’t happen again to anyone else.”

HILLSBOROUGH, N.C. — Attorneys for a University of North Carolina graduate student accused of killing his academic advisor said in court on Tuesday that a doctor has found their client not competent to proceed with trial.

Defense attorneys for Tailei Qi told Superior Court Judge Allen Baddour they plan to file a motion challenging Qi’s capacity to proceed. Meanwhile, the judge granted a request from prosecutors to get a separate competency evaluation.

Qi is charged with killing Dr. Zijie Yan inside a campus laboratory on Aug. 28. Police were alerted when a 911 caller reported gunfire at Caudill Labs. Qi was not at the building when officers arrived soon after.

Police arrested the Chapel Hill resident without force off campus less than two hours after the shooting. He is being held without bond on charges of first-degree murder and having a gun on educational property.

The attack and hourslong lockdown terrified students and faculty who had just returned to campus for the start of the fall semester.

At the Tuesday hearing, Qi spoke multiple times, including asking for new attorneys, WTVD-TV reported.

Superior Court Judge Allen Baddour advised Qi to remain quiet.

“I don’t want you to say anything else today. What I want you to know is that you have two lawyers beside you who are willing to work for you and with you, and what they need from you is your cooperation and your help,” Baddour said.

The campus of the state’s flagship public university was locked down again last week over reports of an armed and dangerous person. No shots were fired and an arrest was made.

Several people carried signs at Monday’s Capitol rally. “Stop the Democratic grooming of our children,” said one.

“My child is not your science experiment,” said another.

But most prominent were the white buttons adorning dresses, shirts, and jackets that read: PROTECT PARENTS’ RIGHTS.

Summertime may be the carefree highlight of the year for school-aged children, but it’s been a turbulent season for local school boards, especially in Southern California.

Boards in Chino and Murrieta enacted policies requiring teachers and school staff to inform parents of changes in their childrens’ gender identity. An Orange County district may soon follow. The Temecula Valley Unified School District voted to reject curriculum that taught about Harvey Milk and the gay rights movement. It backed down and approved the plan after Gov. Gavin Newsom threatened a $1.5 million fine.

On Monday, a group of 200 or so concerned parents, grandparents, and community members from up and down the state gathered to fight back against what they see as the attack on parents’ rights — led by Newsom — and to lobby against several bills making their way through the legislature.

Many of the state’s most outspoken supporters of the parents’ rights movement are newly elected school board members in the Sacramento region. They are confident that their cause — sparked by the lockdowns and mask mandates of the pandemic era and fed by the conviction that schools have become centers of leftist indoctrination — will only gain strength.

“There’s this apparatus of power and we’re realizing where we have influence. And that influence is growing,” said Jonathan Zachreson, who was elected to Roseville City Unified School District last November — one of 26 school board candidates from Colfax to Roseville who ran on a “pro-parent” platform and won in 2022.

Rocklin, Elk Grove school boards seek to strengthen parental rights

Sacramento area school districts could soon be confronted with proposals similar to those that roiled Chino and Temecula.

In Elk Grove Unified School District, the board is set to hear a presentation about parents rights at its next meeting on Sept. 5.

“Given that there is a different understanding with respect to parental rights, I request that the Board of Education have an agenda item in which it receives a report on existing (state) ed code language with respect to parents’ rights,” said Trustee Carmine Forcina at a July school board meeting. “And include within that report any pertinent court cases that affirm the education code statements.”

Forcina does not believe the request for a presentation “is threatening.”

“The intent of having a report at a Board meeting is to give the public … an opportunity to hear the ‘What Is,’” he said at the July session.

At an Aug. 9 board meeting, Rocklin Unified School District Trustee Dereck Counter proposed creation of a subcommittee to consider strengthening parent notification policies. It is scheduled to present on the topic at its next session on Sept. 6.

“I want to look at strengthening parents’ rights notifications with respect to some of our RUSD policies,” Counter said.

“Our teachers, our instructional aides, counselors, staff, all have positive connections with our students … alongside with our great educators that we have, I want to increase the parent notifications, strengthen the parent rights,” he said. “We need to keep parents in all the conversations about substantial changes that would support the academic, social, emotional, and mental growth of our district’s students.”

Board President Julie Hupp seconded the motion to form a subcommittee, and placed herself on it.

Mike Murray, a Rocklin parent running to represent Placer County’s 3rd supervisorial district, is a strong supporter of Counter’s, and three other like-minded pro-parent RUSD trustees: Hupp, Tiffany Saathoff (a pastor at Destiny Church and Republican Assemblyman Joe Patterson’s Chief of Staff), and Rachelle Price.

“As a parent, all we want is transparency,” Murray, who has two children enrolled in RUSD schools, said at the rally Monday.

Like Zachreson, he worries about the slate of state bills “trying to take away local control” from school boards. What works in some communities and local jurisdictions might not make sense in others, he said.

“We want to be part of their lives, be there to help them. We don’t want that taken away by the government.”

Parents’ rights is a ‘collaborative movement’

Many who rallied in Sacramento Monday see their movement as a biblical calling — they answer to God, not the government — and believe that the state is undermining the bedrock principle of local control of schools.

It was the second such demonstration in just one week. Last Wednesday, Sonja Shaw, president of Chino Valley Unified School District, appeared at the Capitol with Assemblyman Bill Essayli, R-Riverside, a fellow “champion of parents’ rights.”

Shaw, a trainer who has become a heroine of the parents’ rights movement, was called by one pastor in attendance “a true, modern day Deborah.” She spoke Monday as well.

“God is using California to guide the way,” Shaw said, against the indoctrination of young kids, and against the “political cartel of Newsom, Bonta and (State Superintendent Tony) Thurmond.”

Thurmond showed up to a Chino Valley school board meeting last month — he says students in the district invited him — and was ousted after a verbal showdown with Shaw, who had him removed. To Thurmond, Shaw is an extremist. To Shaw and her supporters and colleagues, there’s nothing extreme about protecting children.

School boards across even the bluest of states are increasingly made up of parents who see themselves on the front lines of what Shaw called “a spiritual battle” and “a warfare.”

And yet, at Monday’s event, sponsored by the California Family Council with Turning Point USA members present, it would be easy to assume that all attendees are bedfellows in the conservative Christian movement. But activists maintain the parents’ rights movement transcends such identifiers as “Republican” or “Democrat.”

“This is a collaborative movement,” Zachreson said Monday.

Zachreson, who is not religious, was a lifelong No Party Preference voter until the COVID-19 pandemic when he changed his affiliation to Republican.

Prior to his election, Zacherson organized around reopening California schools during the COVID-19 shutdowns. He was an early objector to mask and vaccine mandates, school and business shutdowns, and what he calls violations of individual liberty where medical and educational decisions are concerned.

Now that they are turning their focus to class curriculum, parental notification, increased parental involvement in the classroom, and local control.

One target is Assemblyman Corey Jackson’s AB 1078, which would require a two-thirds supermajority vote from a school board for removal of a book from a library or curriculum. Schools could also be fined if they do not supply enough diverse instructional materials, as required by the Department of Education’s content standards.

The parents’ rights camp believes this “will make it harder for local school boards to remove pornographic books and sexualized curriculum,” per the California Family Council and Capitol Resource Institute.

The movement also opposes Burbank Sen. Anthony Portantino’s SB 596, which would make it a misdemeanor offense to “subject a school employee to threats or harassment for reasons related to their official duties while they are away from a school site or after school hours.”

Zachreson, and other newly elected trustees like him, is not just a school board member — he’s one of many activists participating in a broad, collaborative coalition of elected officials, lawyers, pastors, stay-at-home parents and lobbyists actively trying to change state legislation.

“Parents realized where there were power voids,” Zachreson told The Bee in an interview last week. He cites the California Teachers Association, the California School Board Association, and the state Department of Education for actively excluding parents from important policy decisions. School boards in Southern California, including Yorba Linda, where one board voted to leave the CSBA (96% of California’s schools are members), are moving in the right direction, he said.

And when it comes to coalition building, he and his fellow activists work with anyone across the political spectrum — including lawyer and activist Erin Friday, who spoke on Monday’s rally about saving her daughter from “trans ideology.” Friday is a Democrat and told The Bee she’s also not religious.

In other words: it’s not about politics or parish, it’s about parenting.

“This is not a right-left issue,” she said at the podium to a cheering crowd. “It’s easy to say it’s a right wing religious issue, but it’s a human issue, a family issue.”

In red Placer County, it’s a larger movement to, as Dry Creek Elementary School Board Trustee Jon Fenske put it, “protect the innocence of children.”

Fenske ran with two other newbies in 2022: Jean Pagnone and Jason Walker. The three “J Team” candidates ran a joint campaign and successfully “flipped” the five-person school board to a majority pro-parent governing body.

“If we did not have (these) changes in Dry Creek, we wouldn’t have these discussions about parents’ rights,” Fenske told The Bee last week. “I’ve been called a ‘homophobe book banner,’ but I’m just trying to do what’s best for the kids.”

The families of two students who attend a Virginia school where a 6-year-old student shot and wounded his first-grade teacher last month have filed notices of potential legal action against the school district.

The parents of a first-grader at Richneck Elementary School in Newport News, Virginia, say their daughter suffered from emotional harm after being present in class when her classmate shot his teacher on January 6, according to a legal notice filed by attorney Cheri Belkowitz.

The letter, dated January 30 and sent to former Superintendent Dr. George Parker, also claims that the daughter was “subjected to numerous incidents of bullying, harassment, assault and battery” during the school year. However, administrators “did not take reasonable and appropriate actions to protect” the student, despite being made aware of these issues.

The family of another student alleges their child suffered injuries on the day of the shooting, according to a letter sent by the parents’ attorney, Emily Mapp Brannon, to the city of Newport News. The January 30 letter does not include details on the injuries mentioned. At the time of the shooting, police said no one else was physically injured aside from the teacher.

The school district would not comment in response to the letters. CNN reached out to both attorneys for the families but did not immediately hear back.

The families’ intent to potentially pursue legal action against the district is the latest blow to officials following intense criticism from frustrated parents over the way the situation was handled by administrators.

After the shooting, the superintendent was ousted by a vote from the school board, the school’s assistant principal resigned, the former principal was reassigned to another location, but the district did not say where. The school also implemented additional security measures including metal detectors and clear backpacks.

Further, the letters were filed roughly a week after the teacher’s attorney notified the Newport News School Board of intent to file a lawsuit over administrators’ alleged failure to act when they were allegedly made aware of reports about a gun being on school premises.

Teacher Abigail Zwerner was shot around 2 p.m. on January 6 inside a classroom, roughly 90 minutes after former assistant principal Dr. Ebony Parker was allegedly informed reports of the gun, according the legal notice filed by attorney Diane Toscano, the teacher’s attorney

Toscano’s legal notice also detailed allegations of disturbing behavior displayed by the 6-year-old child prior to the shooting.

Two days before the shooting, the student allegedly “slammed” and broke Zwerner’s cell phone and cursed at guidance counselors, after which he was suspended, according to the document. After the one-day suspension, he returned to Zwerner’s classroom and shot her.

On the day of the shooting, another teacher overheard Zwerner say the 6-year-old student was in a “violent mood,” had threatened to beat up a kindergartner at the school and “angrily stared down the security officer,” according to the legal notice.

After the shooting, the 6-year-old was placed under a temporary detention order and was evaluated at a local hospital. His family has previously said he has a disability he was receiving treatment for at the school.
