After going without a city attorney for more than a year, Chula Vista will finally have a replacement after the California Primary Election on March 5, 2024.

Bart Miesfeld and Marco Verdugo were the top two vote-getters in a Special Election last year and — since neither got 50% of the votes plus one — the candidates face off this election cycle to determine who will represent Chula Vista in legal matters.

The winner will be Chula Vista’s first city attorney since 2022 when Simon Silva won the race despite dying from cancer a few weeks before Election Day.

What is a city attorney?

The city attorney is the legal adviser for all city departments, including the city council and the mayor. The person who holds this role is an attorney and their department is the legal arm for the city. 

Where do the candidates for Chula Vista City attorney stand on the issues?

Both are concerned about what will happen with Chula Vista’s District 4 seat, which was held by former Councilwoman Andrea Cardenas, who resigned on Feb.19.

“We need to get this city back on track,” said Miesfeld, who had previously been appointed as City attorney and served for two years.

“We’ve got a long way to go to restore trust,” added Verdugo, a current deputy city attorney.

Cardenas is facing eight felony counts, stemming from fraud accusations tied to her political consulting business. However, Cardenas was taking the first step towards reelection on the same March primary ballot.

“It is too late to get her name off the ballot,” explained Verdugo. “She’s going to be on the ballot in March, and we could have a situation if she ends up in one of the top two positions.”

California election code says a candidate who wins a primary must be left on the general election ballot. It may not matter that Cardenas’ attorney said she stopped campaigning and resigned her post. Verdugo and Miesfeld disagree with that decision.

“I was calling for Andrea Cardenas to resign last year,” Verdugo said. “My opponent thinks that she should have stayed on and continued her term.”

“That’s accurate,” countered Miesfeld. “And here’s why: I was city attorney when one of our councilmembers was indicted by the district attorney‘s office. Well, that played out. He went to trial, and he was acquitted.”

Miesfeld said Cardenas could still be acquitted.

Oddly enough, Cardenas supported Verdugo in the race for city attorney, not Miesfeld.

“He listed her as one of his key supporters in his campaign materials,” Miesfeld said.

“I think that she made the right decision. She’s been a distraction to the city,” Verdugo concluded.

The post Chula Vista city attorney candidates weigh in on Andrea Cardenas’ resignation – NBC 7 San Diego appeared first on Attorney Legal Counsel.

In San Diego County’s second-largest city, three elections are being held during the California Primary Election, including a special election.

Voters were asked to narrow down the field of candidates for two city council seats. The top two vote-getters will then face off in a run-off election in November.

They were also asked to fill the city attorney seat, which has been vacant since City attorney-elect Simon Silva passed away in 2022 due to cancer.

While the votes won’t be official until they are certified one month after Election Day, here is where the races stand, so far.

The city attorney race is a runoff to fill the remainder of a term ending December 2026 — after Simon Silva won the 2022 election despite dying before Election Day, and officials were unable to remove his name from the ballot.

Chula Vista’s city attorney position, like the mayor, is a citywide race.

Marco Verdugo, deputy city attorney, holds a 58%-42% lead over Bart Miesfield, retired municipal attorney.

Election results for City Councilmember, District 3

District 3 includes the southeastern part of Chula Vista just south of Telegraph Canyon Road covering the Otay Ranch area. The district is currently represented by Alonso Gonzalez, who is termed out.

City commissioner Michael Inzunza took a lead in early results for District 3, pulling in 49% of the vote. Leticia Munguia, nonprofit director, and Daniel D. Rice-Vazquez, businessman, were competing for second place with both at 16% of the vote, respectively.

Election results for City Councilmember, District 4

District 4 includes the southwestern part of Chula Vista starting south of L Street just passing Main Street.

Recently ousted former City Councilwoman Andrea Cardenas remains in the running in a too-close-to-call Chula Vista City Council District 4 election, according to early primary results.

Cesar Fernandez, a teacher and school trustee, currently leads that race with 23% of the vote. Rudy Ramirez, a businessman, is in second with 20% and Cardenas is right behind with 19% of the vote. Following the top three are Christine Brady, educator, engineer and CEO, with 17% and business owner Delfina Gonzalez with 16%.

The top-two vote getters will advance to November’s general election.

Chula Vista’s City Council District 4 seat is unoccupied, after Cardenas resigned the seat last month and the remaining council members declared it officially vacant on Feb. 26.

District attorney George Gascón will face 11 challengers in the March 5 primary election in Los Angeles County. 

The challengers looking to unseat the county’s top prosecutor include five members of his office and two Los Angeles County Superior Court judges.    

The field includes the following candidates on the final list of qualified candidates released Saturday by the Los Angeles County Registrar-Recorder/County Clerk.

• Eric Siddall, a violent crimes prosecutor who has been endorsed by the Association for Deputy District Attorneys, the union representing deputy district attorneys.
• Maria Ramirez, the head deputy district attorney
• Supervising district attorney John McKinney
• Prosecutor Jonathan Hatami
• Prosecutor  Lloyd “Bobcat” Masson
• Nathan Hochman, a former U.S. assistant attorney general who was the Republican candidate for state attorney general in the 2022 general election
• Jeff Chemerinsky, an assistant U.S. attorney
• Criminal defense attorney Dan Kapelovitz  
• Los Angeles County Superior Court Judges Debra Archuleta
• Los Angeles County Superior Court Craig J. Mitchell
• David S. Milton, who retired as a Superior Court judge March 25, 2014

Under the California Constitution, judges are eligible to run for office as long as they take a leave of absence without pay, Rob Oftring, the communications director of the Superior Court of Los Angeles County told City News Service.

If as expected, no candidate receives a majority, the top two finishers will meet in a runoff Nov. 5, like all nonpartisan races on the primary ballot.

Gascón has been under fire since taking office in December 2020, when he issued a series of directives critics have blasted as being soft on crime. The directives include a rule against seeking the death penalty, a ban on transferring juvenile defendants to adult court and prohibitions on filing sentencing-enhancements in most cases.
