WILMINGTON, Del. — Attorneys for Fox Corp. asked a Delaware judge Friday to dismiss a shareholder lawsuit seeking to hold current and former company officials personally liable for the financial fallout stemming from Fox News reports regarding alleged vote rigging in the 2020 election.

Five New York City public employee pension funds, along with Oregon’s public employee retirement fund, allege that former chairman Rupert Murdoch and other Fox Corp. leaders deliberately turned a blind eye to liability risks posed by reporting false claims of vote rigging by election technology companies Dominion Voting Systems and Smartmatic USA.

Smartmatic is suing Fox News for defamation in New York, alleging damages of $2.7 billion. It recently settled a lawsuit in the District of Columbia against One America News Network, another conservative outlet, over reports of vote fraud.

Dominion also filed several defamation lawsuits against those who spread conspiracy theories blaming its election equipment for Donald Trump’s loss in 2020. Last year, Fox News settled a defamation lawsuit filed by Dominion in Delaware for $787 million.

The shareholder plaintiffs also allege that Fox corporate leaders ignored “red flags” about liability arising from a 2017 report suggesting that Seth Rich, a Democratic National Committee staffer, may have been killed because he had leaked Democratic party emails to Wikileaks during the 2016 presidential campaign. Rich, 27, was shot in 2016 in Washington, D.C., in what authorities have said was an attempted robbery.

Fox News retracted the Seth Rich story a week after its initial broadcast, but Rich’s parents sued the network for falsely portraying their son as a criminal and traitor. Fox News settled the lawsuit in 2020 for “millions of dollars,” shortly before program hosts Lou Dobbs and Sean Hannity were to be deposed, according to the shareholder lawsuit.

Joel Friedlander, an attorney for the institutional shareholders, argued that Fox officials waited until the company’s reporting about Rich became a national scandal before addressing the issue. Similarly, according to the shareholders, corporate officials, including Rupert Murdoch and his son, CEO Lachlan Murdoch, allowed Fox News to continue broadcasting false narratives about the 2020 election, despite internal communications suggesting that they knew there was no evidence to support the conspiracy theories.

“The Murdochs could have minimized future monetary exposure, but they chose not to,” Friedlander said. Instead, he argued, they engaged in “bad-faith decision making” with other defendants in a profit-driven effort to retain viewers and remain in Trump’s good graces.

“Decisions were made at the highest level to promote pro-Trump conspiracy theories without editorial control,” Friedlander said.

Defense attorneys argue that the case should be dismissed because the plaintiffs filed their lawsuit without first demanding that the Fox Corp. board take action, as required under Delaware law. They say the plaintiffs also failed to demonstrate that a pre-suit demand on the Fox board would have been futile because at least half of the directors face a substantial likelihood of liability or are not independent of someone who does.

Beyond the “demand futility” issue, defense attorneys also argue that allegations that Fox officials breached their fiduciary duties fail to meet the pleading standards under Delaware and therefore should be dismissed.

Defense attorney William Savitt argued, for example, that neither the Rich settlement, which he described as “immaterial,” nor the allegedly defamatory statements about Dominion and Smartmatic constitute red flags putting directors on notice about the risk of defamation liability. Nor do they demonstrate that directors acted in bad faith or that Fox “utterly failed” to implement and monitor a system to report and mitigate legal risks, including defamation liability risk, according to the defendants.

Savitt noted that the Rich article was promptly retracted, and that the settlement included no admission of liability. The Dominion and Smartmatic statements, meanwhile, gave rise themselves to the currently liability issues and therefore can not serve as red flags about future liability risks, according to the defendants.

“A ‘red flag’ must be what the term commonly implies — warning of a risk of a liability-causing event that allows the directors to take action to avert the event, not notice that a liability-causing event has already occurred,” defense attorneys wrote in their motion to dismiss.

Defense attorneys also say there are no factual allegations to support claims that Fox officials condoned illegal conduct in pursuit of corporate profits, or that they deliberately ignored their oversight responsibilities. They note that a “bad outcome” is not sufficient to demonstrate “bad faith.”

Vice Chancellor J. Travis Laster is expected to rule within 90 days.

LOS ANGELES — Former federal prosecutor Nathan Hochman has advanced to a runoff against Los Angeles County District attorney George Gascón, one of the country’s most progressive prosecutors.

Gascón and Hochman will compete in November in the race to lead an agency that prosecutes cases in the most populous county in the U.S.

Hochman was a one-time California attorney general candidate. Running as a Republican in 2022, he lost to Democratic candidate Rob Bonta. Hochman’s district attorney campaign says he raised $2 million in his bid to unseat Gascón.

To win the primary outright in California, a candidate needs to get a 50%-plus-one vote. Anything less triggers a runoff race between the top two candidates in November regardless of party.

Political experts said Gascón was expected to advance from the nonpartisan primary but are less optimistic about his chances in the fall.

Hochman emerged from 11 challengers running against Gascón, who was elected on a criminal justice reform platform in 2020 in the wake of George Floyd’s killing by police. Gascón faced a recall attempt within his first 100 days and a second attempt later, which both failed to get on the ballot.

Hochman has tried to capitalize on voter anger over crime and homelessness, issues that led voters to unseat San Francisco District attorney Chesa Boudin in a recall election in 2022.

In his campaign ads, Hochman, a defense attorney, vowed to change the direction of the district attorney, saying: “It’s time we had a DA who fights for victims, not criminals.”

The challengers, ranging from line prosecutors in Gascón’s office to county judges to former federal prosecutors like Hochman, sought to blame Gascón and his progressive policies for widespread perceptions that the city is unsafe. They highlighted shocking footage of a series of brazen smash-and-grab robberies at luxury stores. The feeling of being unsafe is so pervasive that even the Los Angeles mayor and police chief said in January that they were working to fix the city’s image.

But while property crime increased nearly 3% within the sheriff’s jurisdiction of Los Angeles County from 2022 to 2023, violent crime decreased almost 1.5% in the same period.

During his first term, Gascón immediately imposed his campaign agenda: not seeking the death penalty; not prosecuting juveniles as adults; ending cash bail for misdemeanors and nonviolent felonies; and no longer filing enhancements triggering stiffer sentences for certain elements of crimes, repeat offenses or gang membership.

He was forced to roll back some of his biggest reforms early in his tenure, such as initially ordering the elimination of more than 100 enhancements and elevating a hate crime from misdemeanor to a felony. The move infuriated victims’ advocates, and Gascón backpedaled, restoring enhancements in cases involving children, older people and people targeted because of their race, ethnicity, sexual orientation or disability.

Hochman has vowed to reverse many or nearly all of his most progressive policies, such as his early orders to eliminate filing for sentencing enhancements.

The post Progressive Los Angeles County District Attorney George Gascón advances to runoff appeared first on Attorney Legal Counsel.

A federal judge in California on Friday ordered Alexander Smirnov, the former FBI informant charged with lying to the bureau about President Joe Biden and his son Hunter Biden, to appear in court Monday morning as the judge considers keeping Smirnov detained pending trial.

Special counsel David Weiss is again seeking to have Smirnov, who is currently in custody, held until his trial date.

In an unusual filing Friday afternoon, District Judge Otis Wright also suggested that an effort by Smirnov’s attorneys to keep him out on release was “likely to facilitate his absconding from the United States.”

Smirnov’s attorneys, in a subsequent filing late Friday, disputed Judge Wright’s characterization, saying, “The suggestion that defense counsel is participating in an unlawful plot by advocating for release under Section 3142 is wrong.”

“We are advocating for Mr. Smirnov’s release in both the federal district court and in the Ninth Circuit Court of Appeals,” attorneys David Chesnoff and Richard Schonfeld told ABC News.

Judge Wright’s order is just latest twist in a dramatic week of events since Smirnov’s arrest last Thursday on charges that he concocted “fabrications” about President Biden and his son accepting $5 million in bribes from the Ukrainian energy giant Burisma — which Republicans have repeatedly cited as a driving force in their efforts to impeach the president.

Earlier this week, in an effort to keep Smirnov detained, Weiss’ office alleged Smirnov had high-level contacts with Russian intelligence officials who they said were “involved in passing a story” to him about Hunter Biden.

“Smirnov’s efforts to spread misinformation about a candidate of one of the two major parties in the United States continues,” the filing stated. “What this shows is that the misinformation he is spreading is not confined to 2020. He is actively peddling new lies that could impact U.S. elections after meeting with Russian intelligence officials in November.”

Arguing that Smirnov presented a clear risk of fleeing the country or obstructing justice if released on bail, prosecutors repeatedly pointed to Smirnov’s extensive claims of contacts with “multiple foreign intelligence agencies” abroad and his plans to leave the U.S. on a multi-country foreign trip just two days after he landed in Las Vegas last week and was taken into custody at the airport.

Despite the surprising extent of disclosures by Weiss in his filing seeking Smirnov’s detention, however, a Nevada magistrate judge ordered Smirnov’ released from custody on the condition that he surrender his passport, wear an ankle monitor and be restricted from travel outside of Nevada and California.

The government sought a stay of the judge’s decision, which was rejected, after which Weiss’ prosecutors sought reconsideration by the original judge overseeing his case in Los Angeles, where Smirnov was indicted by a grand jury.

On Thursday morning, Smirnov’s attorneys said they were deliberating with him over his case at their law office when U.S. Marshals arrived to re-arrest him.

In an effort to prevent him from being transferred to Los Angeles, his attorneys filed an emergency motion with the magistrate in Nevada requesting an order that would bar the U.S. Marshals from taking him out of Las Vegas.

But in his order filed Friday, Judge Wright explained that he signed off on the warrant for Smirnov’s arrest after granting Weiss’ request for a reconsideration of the detention order, which advised the U.S. Marshals “there is to be no deviation from this Order.”

As a result, the Nevada magistrate judge dismissed the requests from Smirnov’s attorneys, conceding “this Court no longer has jurisdiction to decide [Smirnov’s] motions.”

Smirnov is now set to appear before Judge Wright on Monday morning in Los Angeles.

Smirnov has not entered a plea in the case but his attorneys have said he plans to vigorously defend himself against the charges brought by Weiss.

A spokesperson for Weiss’ office declined to comment further.

Attorneys for Hunter Biden on Tuesday moved to dismiss tax-related charges brought by special counsel David Weiss in California, accusing prosecutors of selectively targeting President Joe Biden’s son, violating a statute of limitations, and filing duplicative charges on three counts of failure to pay and tax evasion.

“The special counsel has gone to extreme lengths to bring charges against Mr. Biden that would not have been filed against anyone else,” Hunter Biden’s attorney Abbe Lowell said in a statement.

“Prosecutors reneged on binding agreements, bowed to political pressure to bring unprecedented charges, overreached in their authority, ignored the rules and allowed their agents to run amok, and repeatedly misstated evidence to the court to defend their conduct. It is time to hold the special counsel accountable and dismiss these improper charges,” Lowell said.

Weiss’ office charged Hunter Biden in December with nine felony and misdemeanor charges stemming from his failure to pay $1.4 million in taxes for three years during a time when he was in the throes of addiction. Hunter Biden has pleaded not guilty to all charges.

The back taxes and penalties were eventually paid in full by a third party, identified by ABC News as Hunter Biden’s attorney and confidant, Kevin Morris.

In his motions on Tuesday, Lowell reiterated many of the arguments he waged in his efforts to dismiss three additional felony counts Biden faces in Delaware – charges to which Biden has also pleaded not guilty.

Lowell claimed that the tax indictment is the result of a selective and vindictive prosecution stemming from political pressure, that Weiss was not properly appointed special counsel and therefore lacks authority to file charges, and that an immunity agreement struck by the two parties last summer remains in effect.

Lowell also argued that the statute of limitations for Biden’s alleged failure to pay taxes in 2016 expired in April 2023.

Hunter Biden’s attorneys also challenged the venue of the charges, claiming Biden was a resident of Washington, D.C., at the time and argued that three counts of the indictment “contain serious duplicity problems,” where multiple alleged violations are included in the same count.

In the event the case does move forward, Lowell filed a separate motion seeking to strike “inflammatory characterizations and gratuitous facts and descriptors” included in the indictment that were “meant to depict Mr. Biden as irresponsible, frivolous, and otherwise of questionable character and integrity” during his period in the throes of addiction.

Lowell said they run the risk of “misleading and confusing the jury” if the case moves to trial.

Antisemitic hate incidents have plagued Los Angeles County since Hamas launched a surprise terror attack on Israel on Oct. 7, according to the Los Angeles County District attorney‘s Office.

Los Angeles County District attorney George Gascón announced Tuesday charges against two men, Klinton Allister Dion and Jarris Jay Silagi, for alleged antisemitic hate crimes, including vandalism and assault.

“The escalating wave of antisemitic attacks against the Jewish community will not be tolerated in Los Angeles County,” Gascón said. “We have a zero tolerance for such behavior and our Hate Crimes Unit will work diligently to continue prosecuting such crimes.”

According to the district attorney‘s office, Dion is charged with two counts of vandalism of religious property as a hate crime and 10 counts of hate crime by displaying Nazi symbols, etc.

According to the district attorney‘s office, Dion was allegedly linked to vandalism of Nazi symbols including swastikas, the Iron Cross, and “SS” occurring in late November at a synagogue, an evangelical Christian church, an IHOP, an apartment complex, a bridge, a newspaper stand, and more in Burbank and Glendale.

The district attorney‘s office alleges that the vandalism was committed for “intimidating and deterring persons from freely exercising their religious beliefs.”

An arrest warrant has been issued for Dion. If convicted as charged, Dion could face a maximum sentence of 20 years in state prison.

The suspect was not immediately able to be reached for comment.

On Dec. 9, a 75-year-old man and his wife were on their way to observe Shabbat at a synagogue during the Hanukkah holiday when they were attacked in Beverly Hills, according to the district attorney‘s office.

Officials say Silagi allegedly ran toward them and struck the man, who was wearing a yarmulke, once on his head with a belt. He allegedly attempted to rob the woman as well.

Silagi was charged with one count of attempted second-degree robbery; one count of elder or dependent adult abuse, infliction of injury; one count of assault with a deadly weapon; and two counts of assault by means of force likely to produce great bodily injury.

If convicted as charged, Silagi will face a maximum sentence of life in prison. His appointed counsel told ABC News that they entered a plea of not guilty on his behalf after “the court declared a doubt of his competency.”

“Like anyone charged with a crime, Mr. Silagi is presumed innocent and entitled to a vigorous defense. We are sensitive to the intense public interest this matter has generated, but caution against a rush to judgment until all the facts are established in court,” said Silagi’s legal representative Greg McCambridge, LA County Head Deputy Public Defender.

Federal and local officials nationwide have warned about tensions from the ongoing war in the Middle East between Israel and the terrorist group Hamas spilling over into the United States.

The war appears to have incited intensifying waves of antisemitism, Islamophobia, and other hate incidents across the country.

“Since Oct. 7, though, we’re seeing this – and it’s not just a surge, it’s a hurricane, it’s a tsunami,” said Jeffrey Abrams, Los Angeles Regional Director from the Anti-Defamation League. “What we are seeing unquestionably is an unmasking of hate and antisemitism.”

Los Angeles Police Department alone has recorded a 38% increase in anti-Jewish hate crimes from 2022 to 2023 in a year-to-date comparison. In the same time, LAPD has seen a nearly 57% increase in reported non-crime bias incidents.

The FBI and Department of Homeland Security have released a new Public Service Announcement regarding the heightened threat environment, particularly regarding lone actors.

“Although this announcement is not in response to any specific plotting activity, these targets likely remain attractive to lone actors inspired by a range of ideologies due to their accessibility and symbolic nature,” the alert read.

“We’re seeing this disturbing uptick in hate crimes. Let me reiterate that hate crimes against any individual group based on their identity, religion, race, sexual orientation, or gender identity will not be tolerated in our county,” Gascón said.

He continued, “I want to assure members of the Jewish community that we stand in solidarity with them, and that we will continue to aggressively prosecute these cases our nation is facing a crisis of hate crime.”

For the first time since her arrest, Ruby Franke and her attorney have broken their silence regarding her criminal charges. The popular YouTube celebrity who is charged with several counts of aggravated child abuse said through her attorney LaMar Winward on Saturday that she will plead guilty to the charges against her Monday at the Washington County 5th District Court in Utah.

Franke’s business partner and mental health counselor Jodi Hildebrant also faces six counts of aggravated child abuse. Both women were arrested Aug. 30 after Franke’s 12-year-old son, who had been staying at Hildebrandt’s house, climbed out of a window, ran to a neighbor’s home and told the neighbor that he had been abused.

Hildebrant has not yet entered a plea to the charges.

The Santa Clara-Ivins police in Utah said in a statement that the child “appeared to be emaciated and malnourished, with open wounds and duct tape around the extremities.” Upon searching the home, police said they found Franke’s 10-year-old daughter in the same condition. All of Franke’s four minor children were placed into state care, according to police.

Search warrants obtained by ABC News allege Hildebrandt used cayenne pepper and honey to dress the children’s wounds.

Both women have remained in custody since their arrest.

In his statement, Winward described Franke as a devoted mother committed to constant improvement. He said his client was a victim of “manipulation.”

“Initially, Ms. Franke believed that Jodi Hildebrant had the insight to offer a path to continual improvement. Ms. Hildebrant took advantage of this quest and twisted it into something heinous.  Over an extended period, Ms. Hildebrant systematically isolated Ruby Franke from her extended family, older children, and her husband, Kevin Franke. This prolonged isolation resulted in Ms. Franke being subjected to a distorted sense of morality.”

Ruby Franke’s attorneys say that since her incarceration, she has been “actively engaged in an introspection that has allowed her to reset her moral compass and understand the full weight of her actions.” She is “committed to taking responsibility for the part she played” in the events that led to her arrest, and she is already communicating with family members “to mend relationships and contribute positively to the healing journey of her family,” according to the statement from her attorneys.

Franke and Hildebrandt were business partners in ConneXions, an organization that promises to “encourage healing and facilitate personal growth through impeccable honesty, rigorous personal responsibility and vulnerable humility,” according to its website. Hildebrandt is listed as the founder while Franke is listed as “a certified mental fitness trainer.” Franke also operated ”8 Passengers,” a now defunct YouTube channel that offered parenting advice.

Attorneys for Hildebrandt and Kevin Franke did not immediately respond to ABC News’ requests for comment.

Kevin Franke filed a petition for divorce last month. In an interview with “Good Morning America” in September, an attorney for the husband said he had been separated from his wife for over a year and had no knowledge of the alleged abuse.

LOS ANGELES — Two men who spent decades in prison for crimes they didn’t commit have been exonerated and freed, the Los Angeles County district attorney announced Wednesday.

Giovanni Hernandez and Miguel Solorio had their convictions vacated earlier this year and on Wednesday a judge found them factually innocent, the District attorney‘s Office said in an email.

At a news conference, District attorney George Gascón apologized to both men.

“It’s truly devastating when people are wrongfully convicted, especially when they were so young at the time of their arrest. In the case of Mr. Solorio, he was 19 years old. Mr. Hernandez was just 14 years old,” Gascón said.

After two trials, Hernandez was convicted in 2012 of killing 16-year-old Gary Ortiz during a 2006 drive-by shooting in Culver City. He was sentenced to 50 years to life in prison. Hernandez said he was at home with his family at the time of the shooting.

He was exonerated after his case was twice submitted to the Conviction Integrity Unit of the District attorney‘s Office.

Investigators interviewed witnesses who hadn’t previously been contacted and analyzed Hernandez’s cellphone records, which showed he wasn’t near the shooting location, according to a statement from the DA’s office.

Solorio spent 25 years in prison following his conviction for the 1998 shooting of an 81-year-old woman, Mary Bramlett, in an unincorporated county area near Whittier.

Authorities contended Solorio was driving a car containing gang members who mistakenly shot Bramlett while she was stopped at a red light. She had been driving home with some friends after playing bridge at church.

Solorio, who said he had spent the evening with his girlfriend, was convicted of murder and sentenced to life without the possibility of parole.

His attorney submitted an innocence claim in 2021 to the Conviction Integrity Unit, which concluded on the basis of new evidence that Solorio had been misidentified in a photo lineup, the DA’s office statement said.

Hernandez was represented by the Juvenile Innocence and Fair Sentencing Clinic at Loyola Law School and Solorio was represented by the Northern California Innocence Project.
